Subject: Accept Final Plat - Cushman Campus
Purpose of Item:
Resolution of the Miami City Commission accepting the final plat of CUSHMAN
CAMPUS located between Biscayne Boulevard and NE 5 Avenue, and between NE 59
Street and NE 61 Street, from THE CUSHMAN SCHOOL, INC., executed Arvi Balseiro;
and authorizing the City Manager to execute the related documents for the recordation
of the plat and approving recording the same in the Public Records of Miami -Dade
County, Florida.
Background of Item:
The Plat and Street Committee established per Miami City Code Section 55-1, and
composed of the Departments of Resilience and Public Works, Planning, Building,
Office of Zoning, Police, Fire -Rescue, and Solid Waste, with representation of the Law
Department, has reviewed the Tentative Plat and determined its conformance to the
subdivision regulations of Chapter 55, and Miami 21 Zoning Regulations. The
Department of Resilience and Public Works has reviewed the final plat and has
determined that it is now in order for consideration of acceptance by the Miami City
Commission. The specific intent of this plat is to close and vacate a street within the
boundaries of the proposed plat and to create twelve (12) tracts of land for educational
use. The plat entitled CUSHMAN CAMPUS is a replat of the property described in the
legal description shown as Attachment 1. The platted area consists of approximately
227,336 square feet (5.219 ± acres) as depicted in Exhibits B and C. This plat was
approved under Miami 21 zoning designation T6-8-O, T5-L, T4-R and CI (Urban Core
Transect Zone Open, Urban Center Transect Zone Limited, General Urban Transect
Zone Restricted and Civic Institution Zone).

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE PLAT TITLED "CUSHMAN CAMPUS," A REPLAT IN THE CITY OF
MIAMI OF THE PROPERTY DESCRIBED IN ATTACHMENT "1," SUBJECT TO
SATISFACTION OF ALL CONDITIONS REQUIRED BY THE PLAT AND STREET
COMMITTEE AS SET FORTH IN EXHIBIT "A," ATTACHED AND INCORPORATED,
AND THE PROVISIONS CONTAINED IN SECTION 55-8 OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED; ACCEPTING THE DEDICATIONS SHOWN ON
THE PLAT; AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY
CLERK TO EXECUTE THE PLAT AND CAUSE THE RECORDATION OF THE PLAT
IN THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA.
WHEREAS, the Plat and Street Committee ("PSC"), established pursuant to Chapter
55 of the Code of the City of Miami, Florida, as amended ("City Code"), at its meeting of June
6, 2013 and at subsequent meetings of March 19, 2015, September 1, 2016, April 11, 2019
and January 11, 2024 reviewed the proposed plat titled "CUSHMAN CAMPUS" and
determined that all technical requirements have been met; and
WHEREAS, the re -submitted tentative plat's expiration was extended from October 11,
2019 to August 9, 2028 due to the State of Emergency for Novel Coronavirus ("COVID-19")
pandemic, Hurricane Isaias, Tropical Storm Elsa, the State of Emergency for Freezing
Temperatures and Harm to Agriculture, State of Emergency for Tropical Depression Nine and
Tropical Storm Nicole, pursuant to the provisions of Section 252.363, Florida Statutes; and
WHEREAS the PSC recommends the acceptance of the plat;
WHEREAS the Miami Planning, Zoning and Appeals Board at its meeting on October
16, 2013, adopted Resolution No. PZAB-R-13-052 recommending approval of the vacation
and closure of the street located at approximately Northeast 60 Street from Northeast 5 Court
to Biscayne Boulevard, and Northeast 5 Court from approximately 90 feet Northwest of
Biscayne Boulevard to Northeast 60 Street ("Vacation and Closure"), and
WHEREAS, the Miami City Commission, at its meeting on February 27, 2014,
adopted Resolution No. R-14-0070 approving said Vacation and Closure;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The plat titled "CUSHMAN CAMPUS," a replat of the property described in
Attachment "1," which plat by reference, in substantially the attached form and subject to
satisfaction of all conditions required by the PSC as set forth as Exhibit "A," attached and
incorporated, and the provisions contained in Section 55-8 of the City Code, is accepted.
Section 3. The dedications shown on the plat together with the dedications to the
perpetual use of the public of all existing and future planting, trees, and shrubbery on said
dedications are hereby accepted and confirmed by the City of Miami.
Section 4. The City Manager and City Clerk are authorized' and directed to execute the
aforesaid plat and cause the same to be recorded in the Public Records of Miami -Dade County,
Florida.
Section 5. This Resolution shall become effective immediately upon its adoption.
APPROVED AS TO FORM AND CORRECTNESS:
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and
City Code provisions.
