A RESOLUTION AUTHORIZING THE CITY MANAGER TO
SUBMIT IN WRITING TO THE PRESENT ORANGE BOWL
STADIUM FOOD AND BEVERAGE CONCESSIONAIRE, FOR
THE OPERATION OF THE BEER CONCESSION AT THE
ORANGE BOWL STADIUM, PROPOSED TERMS WHICH HAVE
HERETOFORE BEEN RECEIVED BY THE CITY FROM
INTERESTED PARTIES, SUBJECT TO CERTAIN CONDITIONS,
SAID SUBMISSION AFFORDING THE PRESENT CONCESSIONAIRE
AN OPPORTUNITY TO ACCEPT THE OPERATION OF THE
BEER CONCESSION ON THE PROPOSED TERMS AND TO
INDICATE ITS ACCEPTANCE IN WRITING ON OR BEFORE
AUGUST 11, 1978; FURTHER INSTRUCTING THE CITY
MANAGER, IN THE EVENT OF THE NON -ACCEPTANCE BY
THE AFORESAID CONCESSIONAIRE, TO ADVERTISE TO THE
PUBLIC AT LARGE FOR PROPOSALS TO OPERATE THE
AFORESAID STADIUM BEER CONCESSION, WITH A DEADLINE
THEREON FOR THE RECEIPT OF BIDS AND PROPOSALS
OF AUGUST 25, 1978; AND FURTHER AUTHORIZING THE
CITY MANAGER TO EVALUATE SAID BIDS AND PROPOSALS
AND AWARD THE CONTRACT TO THAT BIDDER WHOSE
PROPOSAL AND BID CONTAINS TERMS MOST ADVANTAGEOUS
TO THE CITY, WITH THE FINAL EXECUTION OF THE
WRITTEN CONTRACT SUBJECT TO THE APPROVAL OF THE
CITY COMMISSION.
WHEREAS, the City Commission authorized the sale of
beer and/or malt beverages in the Orange Bowl Stadium through
Ordinance No. 8735, adopted January 11, 1978, and made such sale
subject to and conditioned upon such terms and conditions as
specified by the City Manager
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION

Section 1. The City Manager is auth .zed to evaluate
all proposals which have been submitted to the City of Miami by
parties who are interested in operating the beer concession
at the Orange Bowl Stadium, giving his particular attention
to the reputation of the party or parties submitting bids and
also giving his particular attention to the ability of the
party to successfully operate the concession; further directing

the City Manager to submit, in writing, to the present Orange
Bowl Stadium food and beverage concessionaire, those ,proposed
terms which are most advantageous to the City of Miami, subject
to the following Conditions:
(a) That the dispensing of beer in the Stadium
.not be made in bottles or in cans and the dispensing system be
installed at no cost to the City.
(b) That the operation of the concession consist of
a system capable of dispensing a minimum of 100,000 servings of
beer at any one football game.
(c) That the price of beer to the consumer or
stadium patron be reasonable and at a level comparable to
prices charged in other city stadia.
(d) That the City receive not less than 45% of the
gross receipts from the beer concession.
Section 2. The City Manager is hereby instructed to
allow the present concessionaire up to and until 5 o'clock P.M.
on August 11, 1978, within -:which to accept, in writing, the
aforesaid terms and conditions. In the event no acceptance
is forthcoming within the above stated time, the City Manager
is hereby instructed to advertise to the public at large for
proposals to operate the Orange Bowl Stadium beer concession,
with a deadline for the receipt of bids and proposals of
5 o'clock P.M. on August 25, 1978.
Section 3. The City Manager is hereby authorized upon
receipt of the aforesaid bids, and the opening thereof, to evalu-
ate the same and award the bid to the concessionaire whose
proposal contains terms which are most advantageous to the City
of Miami, with the execution of the contract between the City and
the said concessionaire being Subject to the approval of the
City Commission,

THIS LETTER IS DESIGNED TO INDICATE THE READI-
NESS OF TO PROVIDE BEER FOR
THE PATRONS OF THE ORANGE BOWL STADIUM. WE RECOG-
NIZE THE LOGISTICS INVOLVED AND ARE CONFIDENT OF OUR
ABILITY TO UTILIZE OUR DISPENSING SYSTEMS, AT NO
INSTALLATION COST TO THE CITY, FOR PREMIUM BEER SER-
VICE.
• IS ALSO AWARE OF THE
POSSIBILITY THAT THE TERM OF THE AGREEMENT MAY ONLY
BE FOR A TWO (2) YEAR PERIOD. HOWEVER, THIS ORGANI-
ZATION IS PREPARED TO COMMENCE SERVICE WITHIN FIVE
(5) DAYS FOLLOWING NOTIFICATION FROM THE CITY.
AS PAYMENT FOR THE RIGHT TO EXERCISE THESE ABOVE
MENTIONED PRIVILEGES, AGREES TO PAY TO THE
CITY FORTY-FIVE PER CENT (45X) OF THE GROSS RECEIPTS
DERIVED FROM IT'S OPERATIONS.
