HomeMy WebLinkAboutO-08818AnNtilaNT 21 to MANOt O. a7s1 ORDINANCE NO. 8818 AN EMEROENOY ORDINANCE AMENDINC SECTttii S 1 end 5 OF ORDINANCE NO, 8731, ADOPTED DECEMBER 16, 1977, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FiSCAt.► YEAR ENDING SEPTEMBER 30, 1978, AS AMENDED, TO ()PP ' A "1976-77 FUND BALANCE DEFICIT" OF $95,736 AND BY: INCREASING THE 1977.78 GENERAL FUND APPROPRIATION FOR: THE FIRE DEPARTMENT BY $46,425; HUMAN RESOURCES DEPARTMENT BY $98,000 .FOR 1977-78 TEST VALIDATION SERVICES PROVIDED BY THE UNIVERSITY OF CHICAGO UNDER THE COHEN CONSENT DECREE; AND INCREASING THE GENERAL FUND ANTICIPATED REVENUES, IN AN AMOUNT of $240,161 FROM THE STREET LIGHTING FUND; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND DISPENSING WITH THE REQUIREMENT OF READING THE SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -PITHS OF THE MEMBERS OF THE COMMISSION. WHEREAS, the City Commission adopted Ordinance No. 8731 on December 16, 1977, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 30, 1978; and WHEREAS, the City's auditors, Peat, Marwick, Mitchell and Company, have concluded that the fund balance for Fiscal Year 1976-77 is a deficit of $95,736; and WHEREAS, an amount of $46,425 is needed to fund medical examinations requested by the Fire Department for its new physical improve- ment program to determine the health of the firemen and the extent to which they can participate in physical activities; and WHEREAS, the City of Miami has a contract with the University of Chicago to perform test validation and examination for the Police and Fire Departments as required under the Cohen Consent Decree; and WHEREAS, an amount of $98,000 is needed by the Human Resources Department to reimburse the University of Chicago for test validation and examination services rendered in Fiscal Year 1977-78; and WHEREAS, funds are available from prior years' balance in the. Section 4, if any section, part of section, patagi aph, dlause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall iiot be affected. Section S. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the pre- servation of peace, health, safety, and property of the City of Miami, and upon the further ground of the necessity to make the required and necessary payments to its employees and officers, payment of its contracts, payment of interest and principal on its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of its municipal affairs. Section 6. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission.
