HomeMy WebLinkAboutR-78-0442s 6/1/78 RESOLUTION N0. 7 8' 4 4 2 A RESOLUTION GRANTING A ONE YEAR EXTENSION OF THE VARIANCE AS LISTED IN ORDINANCE NO. 6871, ARTICLE IV, SECTION 11 (1), TO PERMIT REPLATTING OF A LOT KNOWN AS TRACT "C", WITH A + 50' AVERAGE WIDTH (60' REQUIRED), IN CONJUNCTION WITH TENTATIVE PLAT #994-A "DOUGLAS GARDENS HOUSING", ZONED R-1 (ONE FAMILY) , R-2 (TWO FAMILY). THIS VARIANCE IN CON- JUNCTION WITH (A) A STREET CLOSURE APPLICATION AS PART OF THE CONDITION OF APPROVAL OF THE ABOVE TENTATIVE PLAT, (B) VARIANCE PETITION FOR LOT COVERAGE, (C) CHANGE OF ZONING PETITION FOR PARTS OF TRACTS "A" AND "B", AND (D) CONDITIONAL USE PETITION FOR CONSTRUCTION OF A BUILDING IN CONNECTION WITH AN INSTITUTION FOR THE AGED. WHEREAS, Article XXXI of the Comprehensive Zoning Ordinance No. 6871, permits an extension of a Variance by the City Manager with approval by the City Commission for a period of one year; and WHEREAS, the City Manager recommends a one year extension of the Variance granted by the Zoning Board by Resolution No. ZB 14-78; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a one year extension of the Variance as listed in Ordinance No. 6871, Article IV, Section 11 (1), to permit replatting of a lot known as Tract "C", with a + 50' average width (60' required), in conjunction with tentative plat #994-A "DOUGLAS GARDENS HOUSING", zoned R-1 (One Family), R-2 (Two Family); said Variance in conjunction with (A) A street closure application as part of the condition of approval of the above tentative plat, (B) A Variance Petition for lot coverage, (C) Change of zoning petition for parts of Tracts "A" and "B" and (D) Conditional use petition for construction of a building in connection with an institution for the aged, granted by Zoning Board Resolution No. ZB 14-78, be and the same is hereby granted. not used. IJL LJ- ARTICLES XXXI AND XXXII of the Comprehensive Zoning Ordinance No.6871 provide that any Variances and Conditional Uses shall expire six months after the effective date of the Variance or Conditional Use unless a Building Permit or a Certificate of Use has been issued based upon the variance or Conditional Use. The Ordinance further provides that the City Manager may, after reveiw and determination that substantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the Variance or Conditional Use for an additional period of time not to exceed one year, subject to approval of the City Commission. This Department finds no objection to the granting of the extensions of time for these Variances and Conditional Use. We are requesting the City Attorneys office, by copy of this memo, to prepare the proper Resolutions for these extensions. cc: Law Department Planning Department Tentative City Commission date: June 22, 1978.
