HomeMy WebLinkAboutR-78-0441s 6/ ./78 RESOLUTION NO. 7 8- 4 4 1 A RESOLUTION GRANTING A ONE YEAR EXTENSION OF THE VARIANCE AS LISTED IN ORDINANCE NO. 6871, ARTICLE VIII, SECTION 6, TO PERMIT CONSTRUCTION OF A 2-STORY STORAGE BUILDING AND A 9-STORY APARTMENT BUILDING ON TRACTS "A" AND "B", TENTATIVE PLAT #994-A "DOUGLAS GARDENS HOUSING" BEING 151 N.E. 52ND STREET, AS PER PLANS ON FILE, WITH A 28% LOT COVERAGE (27.5% PERMITTED); SUBJECT TO A CHANGE OF ZONING TO R-4 ON PART OF SAID TRACTS "A" AND "B" AND SUBJECT TO THE RECORDING OF TENTATIVE PLAT q,994-A; PROPERTY ZONED R-1, R-2 AND R-4, PORTIONS ZONED R-1 AND R-2 PROPOSED TO BE REZONED TO R-4. THIS VARIANCE IN CONJUNCTION WITH: (A) CHANGE OF ZONING PETITION FOR PARTS OF TRACTS "A" AND "B"; (B) STREET CLOSURE APPLICATION AND VARIANCE PETITION FOR A SUB -MINIMUM WIDTH LOT KNOWN AS TRACT "C", AS PART OF THE CONDITIONS OF APPROVAL OF TENTATIVE PLAT #994-A; AND (C) CONDITIONAL USE PETITION FOR CONSTRUCTION OF A BUILDING IN CONNECTION WITH AN INSTITUTION FOR THE AGED. WHEREAS, Article XXXI of the Comprehensive Zoning Ordinance No. 6871, permits an extension of a Variance by the City Manager with approval by the City Commission for a period of one year; and WHEREAS, the City Manager recommends a one year extension of the Variance granted by the Zoning Board by Resolution No. ZB 17-78; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE "DOCUMENT INDEX " Section 1. The request for a one yearigtIOnNbn--of--t•he— CITY OF MIAMI, FLORIDA: Variance as listed in Ordinance No. 687•1, Article VIII, Section 6, to permit construction of a 2-story storage building and a 9-story apartment building on Tracts "A" and "B", Tentative Plat No. 994-A "DOUGLAS GARDENS HOUSING" being 151 N.E. 52nd Street, as per plans on file, with a 28% lot coverage (27.5% permitted); subject to a change of zoning to R-4 on part of said Tracts "A" and "B" and subject to the recording of Tentative Plat #994-A; property zoned R-1, R-2 and R-4, portions zoned R-1 and R-2 proposed to be rezoned to R-4; said Variance in conjunction with: (A) Change of Zoning Petition for parts of Tracts "A" and "B", (B) Street closure application and Variance Petition for a sub -minimum width lot known as Tract "C", as part of the conditions of approval of Tentative Plat #994-A, and (C) Conditional use petition for construction of a building in connection with an institution for the aged, granted by Zoning Board Resolution No, ZB 17-78, be and the same is hereby granted. 78-441 at- Section 2. IJL LJ- ARTICLES XXXI AND XXXII of the Comprehensive Zoning Ordinance No.6871 provide that any Variances and Conditional Uses shall expire six months after the effective date of the Variance or Conditional Use unless a Building Permit or a Certificate of Use has been issued based upon the variance or Conditional Use. The Ordinance further provides that the City Manager may, after reveiw and determination that substantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the Variance or Conditional Use for an additional period of time not to exceed one year, subject to approval of the City Commission. This Department finds no objection to the granting of the extensions of time for these Variances and Conditional Use. We are requesting the City Attorneys office, by copy of this memo, to prepare the proper Resolutions for these extensions. cc: Law Department Planning Department Tentative City Commission date: June 22, 1978.
