HomeMy WebLinkAboutR-78-0440s 6/1/78 RESOLUTION No . 7 8 - 4 4 A RESOLUTION GRANTING A ONE YEAR EXTENSION OF THE CONDITIONAL USE AS LISTED IN ORDINANCE NO. 6871, ARTICLE VIII, SECTION 1 (11) (d), TO PERMIT CONSTRUCTION OF A 9-STORY APARTMENT BUILDING TO BE USED AS A PART OF THE MIAMI JEWISH HOME AND HOSPITAL FOR THE AGED ON TRACTS "A" AND "B" OF TENTATIVE PLAT 1994-A "DOUGLAS GARDENS HOUSING" BEING 151 N.E. 52ND STREET AS PER PLANS ON FILE AND SUBJECT TO THE RECORDING OF THE TENTATIVE PLAT; ZONED R-1, R-2 AND R-4; PORTIONS ZONED R-1 AND R-2 PROPOSED TO BE REZONED R-4. THIS CONDITIONAL USE IN CONJUNCTION WITH: (A) STREET CLOSURE APPLICATION AND VARIANCE PETITION FOR A SUB -MINIMUM WIDTH LOT KNOWN AS TRACT "C", AS PART OF THE CONDITIONS OF APPROVAL OF TENTATIVE PLAT /,&994-A; (B) A VARIANCE PETITION FOR LOT COVERAGE: AND (C) CHANGE OF ZONING PETITION FOR PARTS OF TRACTS "A" AND "B" OF TENTATIVE PLAT #994-A; SUBJECT TO LANDSCAPING APPROVAL BY THE PLANNING DEPARTMENT. WHEREAS, Article XXXII of the Comprehensive Zoning Ordinance No. 6871, permits an extension of a Conditional Use by the City Manager with approval by the City Commission for a period of one year; and WHEREAS,the City Manager recommends a one year extension of the Conditional Use granted by the Zoning Board by Resolution No. ZB 16-78; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: "DOCUMENT INDEX 1.The request for a one I��ril �ftst /of the Sectionq y Conditional Use as listed in Ordinance No. 6871, Article VIII, Section 1 (11) (d), to permit construction of a 9-story apartment building to be used as a part of the Miami Jewish Home and Hospital for the Aged on Tracts "A" and "B" of Tentative Plat #994-A "DOUGLAS GARDENS HOUSING" being 151 N.E. 52nd Street as per plans on file and subject to the recording of the Tentative Plat, zoned R-1, R-2 and R-4; portions zoned R-1 and R-2 proposed to be rezoned R-4; said Conditional Use in conjunction with: (A) Street closure application and variance petition for a sub -minimum width lot known as Tract "C", as part of the conditions of approval of Tentative Plat jfb994-A, (B) A variance petition for Lot Coverage; and (C) Change of zoning petition for parts of Tracts "A" and "B" of Tentative Plat #994-A; Subject to landscaping approval by the Planning Department, granted by Zoning Board Resolution No. ZB 16-78, be and the same is hereby granted. 78-440 f Secttot 2. IJL LJ- ARTICLES XXXI AND XXXII of the Comprehensive Zoning Ordinance No.6871 provide that any Variances and Conditional Uses shall expire six months after the effective date of the Variance or Conditional Use unless a Building Permit or a Certificate of Use has been issued based upon the variance or Conditional Use. The Ordinance further provides that the City Manager may, after reveiw and determination that substantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the Variance or Conditional Use for an additional period of time not to exceed one year, subject to approval of the City Commission. This Department finds no objection to the granting of the extensions of time for these Variances and Conditional Use. We are requesting the City Attorneys office, by copy of this memo, to prepare the proper Resolutions for these extensions. cc: Law Department Planning Department Tentative City Commission date: June 22, 1978. MIAMILAW Douglas Gardens (Jewish Bore for the Aged) N.E. 5lst St. and 2nd Ave. Miami, Florida Please consider this letter as a request, on behalf of the owner of the subject property, for an extension of time within which to continence construction on the proposed apart ment building to be built on the property, for which variances were previously granted. In January of 1978, the Zoning Hoard granted the following variances: Nos. 14-78, 16-78 and 17-78. These variances were granted in connection with the proposed construction of an elderly housing facility to be operated in conjunction with the existing facilities at Douglas Gardens. The architects are presently finishing the preparation of the final working drawings and specifications for the building and it is anticipated that construction will start in the third or fourth quarter of this year. Accordingly, it is necessary to ask for this extension in order to continue to keep the variances previously granted in full force and effect.
