HomeMy WebLinkAboutR-78-04384 s 5/30/78 RESOLUTION NO. 7 8 - 4 3 8 A RESOLUTION GRANTING A ONE YEAR EXTENSION OF THE VARIANCE AS LISTED IN ORDINANCE NO, 6871, ARTICLE X, SECTION 3(2)(d) AND 6, TO PERMIT CONSTRUCTION OF AN APARTMENT BUILDING (THE BABYLON APARTMENTS) ON LOT 5, BLOCK 2, POINT VIEW AMD (2-93), BEING CORNER OF S.E. 14TH STREET AND SOUTH BAYSHORE DRIVE, AS PER PLANS ON FILE, WITH 15' SIDE YARDS (20.83' REQUIRED), AND 34% LOT COVERAGE (24% PERMITTED); ZONED R-5 (HIGH DENSITY MULTIPLE), AND SUBJECT TO: (1) DEDICATION OF ALL OF OUT -LOT #5, AND OF THE 10' OF LOT #5 ITSELF ALONG THE RIGHT-OF-WAY OF S.E. 14TH STREET, (2) FINAL LANDSCAPE APPROVAL BY THE PLANNING DEPARTMENT; ZONED R-5 (HIGH DENSITY MULTIPLE DWELLING); GRANTED BY ZONING BOARD RESOLUTION NO. ZB 228-77. WHEREAS, Article XXXI of the Comprehensive Zoning Ordinance No. 6871, permits an extension of a Variance by the City Manager with approval by the City Commission, for a period of one year; and WHEREAS, the City Manager recommends a one year extension of the Variance granted by the Zoning Board by Resolution No. ZB 228-77; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF T , INDEX CITY OF MIAMI, FLORIDA: ITEM NO.11 Section 1. The request for a one year extension o Variance as listed in Ordinance No. 6871, Article X, Section 3(2)(d) and 6, to permit construction of an apartment building (The Babylon Apartments) on Lot 5, Block 2, POINT VIEW AMD (2-93), being corner of S.E. 14th Street and South Bayshore Drive, as per plans on file, with 15' side yards (20.83' required), and 34% Lot Coverage (24% permitted); zoned R-5 (High Density Multiple), and subject to: (1) Dedication of all of Out -Lot #5, and of the 10' of Lot #5 itself along the right-of-way of S.E. 14th Street, (2) Final landscape approval by the Planning Department, granted by Zoning Board Resolution No. ZB 228-77, be and the same is hereby granted. Dayehore ARTICLE XXXI of the Comprehensive Zoning Ordinance No. 6871 provides that any Variance shall expire six months after the effective date of the Variance unless a Building Permit or a Certificate of Use has been issued based upon the Variance. The Ordinance further provides that the City Manager may, after review and determination that sub- stantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the Variance for an additional period of time not to exceed one year, subject to approval of the City Commission. This Department finds no objection to the granting of the extension of time for this Variance. Please note that I am enclosing herewith a photocopy of the above captioned resolution for ease of refer- ence. With regard to said resolution, please be advised that the undersigned on behalf of Bayshore Properties Development Corporation, hereby respectfully submits written request for extension of one (1) year within which to obtain a Building Permit or Certificate of Use for the subject property.
