HomeMy WebLinkAboutR-78-0427alla -7r RESOLUTION NO. ` 8 27 A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE PUBLIC HEALTH TRUST OF DADE COUNTY, FLORIDA WHICH OPERATES JACKSON MEMORIAL HOSPITAL AND THE UNIVERSITY OF MIAMI FOR THE COORDINATION OF EMERGENCY MEDICAL SERVICES SUBSTANTIALLY IN ACCORDANCE WITH THE TERMS AND CONDITIONS SET FORTH IN THE ATTACHED AGREEMENT; WITH FUNDS THEREFOR ALLOCATED THROUGH THE FIRE DEPARTMENT'S GENERAL BUDGET. WHEREAS, the City of Miami, the Public Health Trust, of Dade County and the University of Miami desire to cooperate to provide services in connection with the Emergency Medical Services provided by the Rescue Division of the City of Miami Fire Department; and WHEREAS, the funds are allocated through the Fire Depart- ment general budget; and WHEREAS, the City Manager recommends approval; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized and directed to enter into an agreement with the Public Health Trust of Dade County and the University of Miami for services in connection with the Emergency Medical Services provided by the Rescue Division of the City of Miami Fire Department, in accordance with the terms and conditions as set forth in the attached agreement. By copy of this memorandum, I am requesting the City Attorney to ap- prove and forward the original copy of this Contract Agreement to the Agenda Secretary together with the original proposed resolution. It is requested that this matter be placed on the City Commission Agenda for June 22, 1978. DEPARTMENT.OF FIRE Attached is the Contract Agreement between the City of Miami, the Public Health Trust and the University of Miami which speaks to the liabilities, responsibilities and compensation of each participant and their relationship to each other. The previous contract expired on March 31, 1978. This Contract is the result of several meetings by the participants and their respec- tive legal staffs and will be executed by the Public Health Trust and the University of Miami. The basic services provided by each participant remains the same; the primary difference in the new Contract is that the State Statutes and the rules of the Department of Health Rehabilitation Services are incorporated in this Contract. A contract with a Medical Director is required by law. The responsi- bility of the Medical Director has been increased significantly. This Contract assures the citizens of the City of Miami the continua- tion of the best pre -hospital paramedic care to be found any where. June 13, 1978 MIME MEW meow MIME MEW NEM MEP mmw MME Is▪ name MBE PAW MME M▪ EV mow ENSk MST Mix ONTRACT BETWEEN CITY OP t4IAMI, PUBLIC HEALTH TRUST, AND UNIVERSITY OF MIAtMI THIS AGREEMENT, entered into this day of 1978, by and between the City of Miami, a municipal corporation of the State of Florida, (hereinafter referred to as the "CITY") the Public Health Trust of Dade County, Florida, (hereinafter referred to as the "TRUST") which operates Jackson Memorial Hospital, and the University of Miami, (hereinafter referred to as the "UNIVERSITY"). WITNESSETH WHEREAS, the CITY, the TRUST, and the UNIVERSITY desire to cooperate to provide certain services in connection with the emergency medical services provided by the Rescue Division, City of Miami Fire Department; NOW THEREFORE, in consideration of the premises and the mutual covenants and agreements herein contained, the parties hereto agree as follows: A. The Public Health Trust agrees: 1. To provide support in the form of licensed house staff members from Jackson Memorial Hospital, each of whom is qualified to practice medicine at the hospital, and is fluent in the English language. Said physicians will be available on a 24-hour basis for prompt response to emergency medical radio transmissions from City of Miami Fire Department Rescue Units. B. The University of Miami agrees: 1. To provide a qualified medical director, acceptable to the CITY, to provide support in accordance with state law and regulations to the Emergency Medical System of the City of Miami. Said medical director (or his alternate, as provided for in Para- graph B2) shall supervise house staff members of Jackson Memorial Hospital who are provided by the TRUST for prompt response to emergency medical radio transmissions from City of Miami Fire Department Rescue Units, 1111 II II II III II I IIIIIl1I1 IIII III 1111 IIIII 78-427 2+ To provide alternate physicians, acceptable to the Medical bisector and to the CITY, in order to endeavor to insure that qualified relief supervision is always provided during the Medical Director's absence from the system. 3. That the Medical Director and his alternates shall be fluent in the English language and qualified to practice medicine at Jackson Memorial Hospital. 4. To provide legal services as may be required by the Medical Director in the performance of his responsibilities. 5. To utilize the compensation outlined in Section C below solely for expenses associated with support of the Emergency Medical System of the City of Miami. C. The City agrees: 1. To pay to the University of Miami as compensation for services, the annual sum of $10,000.00, payable in equal quarterly installments. 2. That all paramedical personnel assigned to advanced life support vehicles will be approved by the Medical Director and the Fire Chief of Rescue. 3. To provide to the Medical Director a list of equipment carried on the advanced life support vehicles which list shall be in accordance with the equipment required by regulations of the Department of Health and Rehabilitative Services and Florida Statutes 401. 4. To carry said equipment on all fire rescue vehicles used. In the event that the Medical Director determines that the equip- ment listed does not meet the requirements of the regulations, the CITY agrees that it will immediately take the necessary action to bring the equipment carried on the advanced life support vehicles into compliance with the regulations. - 'J D. All patties agree that: 1. The CITY agrees to indemnify and hold harmless the UNIVERSITY, DI= COUNTY and the TRUST against any and all liabilities arising out of the negligence by employees and/or personnel of the CITY which may arise during the period that care, custody and control of a patient is in the hands of a rescue squad of the Rescue Division and, at its own cost and expense shall defend Dade County, the UNIVERSITY, the TRUST and any of their respective officers, Trustees or employees against any such claim brought against any of them. 2. The UNIVERSITY agrees to indemnify and hold harmless the CITY, .DADE COUNTY and the TRUST against any and all liabilities arising out of the negligence by employees and/or personnel of the UNIVERSITY which may arise during the period that care, custody and control of a patient is in the hands of a rescue squad of the Rescue Division and, at its own cost and expense shall defend the CITY, DADE COUNTY, and TRUST and any of their respective officers, Trustees or employees against any such claim brought against any of them. 3. The TRUST agrees to indemnify and hold harmless the CITY, DADE COUNTY and the UNIVERSITY against any and all liabilities arising out of the negligence by employees and/or personnel of the TRUST which may arise during the period that care, custody and control of a patient is in the hands of a rescue squad of the Rescue Division and, at its own cost and expense shall defend the CITY, DADE COUNTY, the UNIVERSITY and any of their respective officers, Trustees or employees against any such claim brought against any of them. 4. It is further provided that in no event shall the agents, contractors, officers servants of employees of the CITY be considered to be agents, officers servants or employees of the TRUST or UNIVERSITY. 5. All parties will comply with Florida Statutes, Sections 401.21 through 401.47 and the implementing regulations promulgated by the Department of Health and Rehabilitative Services. 6. That this Agreement shall commence on July 1, 1978 and shall continue through June 30, 1979, provided however, that any party may cancel the Agreement by giving sixty (60)'days notice in writing to all other parties by certified mail, return receipt requested. Notice is effective upon receipt. 7. This Agreement contains the entire Agreement of the parties and that there are no conditions or limitations to this undertaking except those stated herein. After the execution hereof, no alteration, executed in writing and signed by all parties heerto. 8. Box 330708 Miami, Florida 33133 Dear Mr. Graissie: The Statewide Health Coordinating Council (SHCC) is required'by public law to conduct public hearings relative to a new state health plan which they are in the process of developing. This is a volunteer group appointed by the Governor under the provisions of P.L. 93-641, the "National Health Planning and Resources Development Act of 1974". Yesterday, I talked with Ms. Bush whom I understand is the Auditorium Manager for the Bayfront Park Auditorium. She confirmed that September 20, 1978 is an open date for this auditorium and made a reservation for the abov erenced public hearing for us por that date. We will need he build]. ,from 1:00 p.m. until liJ00 p.m. We request that t e $350.00 yrge for the use of the building be waived since this ated public hearing. Should you have questions relative to this public hearing, Mrs. Rose Gordon is a member of the SHCC and I am sure she would be happy to talk with you about the public hearing and explain the charge of the SHCC relative to the public hearing. We would expect to pay for any necessary insurance, the use of the public address system, etc. Would you please confirm to us in writing that the building will be available to us on September 20, 1978 from 1:00 p.m. until 9:00 p.m. and fill us in on any/details that we should know about.
