HomeMy WebLinkAboutR-25-0449City of Miami Resolution R-25-0449 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 18419 Final Action Date: 10/23/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ALLOCATING FUNDS FROM THE DISTRICT 4 COMMISSIONER'S SHARE OF THE FUNDS APPORTIONED BETWEEN THE FIVE (5) COMMISSION DISTRICTS PURSUANT TO THE ANTI -POVERTY INITIATIVE FORMULA FOR THE COMMISSIONER OF EACH DISTRICT IN A TOTAL AMOUNT NOT TO EXCEED FIVE HUNDRED THOUSAND AND 00/100 DOLLARS ($500,000.00) FOR THE DISTRICT SPONSORED "DISTRICT 4 SENIOR RENTAL ASSISTANCE PROGRAM" ("PROGRAM"); FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, SUBJECT TO APPLICABLE REQUIREMENTS OF ALL FEDERAL, STATE, AND LOCAL LAWS, INCLUDING THE CHARTER OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AND CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; THE USE, ALLOCATION, AND APPROPRIATION OF THE FUNDS REFERENCED HEREIN ARE SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS AND THE RECEIPT OF ALL NECESSARY APPROVALS, INCLUDING, BUT NOT LIMITED TO THE CITY ATTORNEY; AUTHORIZING THE CITY MANAGER TO MAKE ANY CHANGES TO ADJUST, AMEND, AND APPROPRIATE THE CITY'S OPERATING BUDGET, FIVE-YEAR FINANCIAL PLAN, STRATEGIC PLAN, MULTI -YEAR CAPITAL PLAN, AND OTHER DOCUMENTS AS NECESSARY AND APPLICABLE, PURSUANT TO THE PROVISIONS OF THIS RESOLUTION; AUTHORIZING, RATIFYING, APPROVING, AND CONFIRMING CERTAIN NECESSARY ACTIONS BY THE CITY MANAGER AND THE DESIGNATED CITY DEPARTMENTS TO UPDATE THE RELEVANT FINANCIAL CONTROLS, PROJECT CLOSE-OUTS, ACCOUNTING ENTRIES, AND COMPUTER SYSTEMS IN CONNECTION HEREWITH. SPONSOR(S): Commissioner Ralph "Rafael" Rosado WHEREAS, on October 9, 2025, pursuant to Resolution No. R-25-0431, the City of Miami ("City") apportioned Five Million, Two Hundred Fifty Thousand, Two Hundred Fifty -One and 19/100 Dollars ($5,250,251.19) in available funds between the five (5) Commission Districts pursuant to the Anti -Poverty Initiative ("API") Formula for the Commissioner of each District to allocate and appropriate by future resolution(s) to district specific affordable housing and/or senior rental assistance programs; and WHEREAS, the Office of the District 4 Commissioner was apportioned One Million, One Hundred Thirteen Thousand and 00/100 Dollars ($1,113,000.00) for affordable housing and/or senior rental assistance programs pursuant to the API Formula; and City of Miami Page 1 of 3 File ID: 18419 (Revision:) Printed On: 1/12/2026 File ID: 18419 Enactment Number: R-25-0449 WHEREAS, on December 12, 2019, pursuant to Resolution No. R-19-0516, the City Commission approved the creation of the permanent Senior Rental Assistance Program, as amended from time to time ("Senior Rental Assistance Program"); and WHEREAS, the goal of the Program is to alleviate the burden caused by rent increases for the City's senior residents who are on a fixed income and find it difficult to afford rising rent; and WHEREAS, due to the high rents and cost of living in the City, the Office of the District 4 Commissioner wishes to allocate Five Hundred Thousand and 00/100 Dollars ($500,000.00) of its funds to support its "District 4 Senior Rental Assistance Program," to provide additional funding to the Senior Rental Assistance Program to assist District 4 senior residents that require and qualify for rental assistance prior to November 1, 2025 ("District 4 Program"); and WHEREAS, the District 4 Commissioner ("Commissioner") wishes to provide funds in an amount not to exceed Five Hundred Thousand and 00/100 Dollars ($500,000.00) ("Funds") for the Program; and WHEREAS, the City Commission finds that this allocation is an allowable use and complies with the provisions of Resolution No. R-25-0431; and WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute any and all documents necessary, all in forms acceptable to the City Attorney, for the allocation of the Funds for the Program; and WHEREAS, in accordance with Section 2-33(f) of the City Code, the City Commission, by a majority vote, hereby deems this Resolution to be of an emergency nature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is authorized' to allocate the Funds for the Program. Section 3. The City Manager is further authorized' to negotiate and execute any and all documents necessary, modifications, and amendments, all in forms acceptable to the City Attorney, for said purpose. Section 4. The use, allocation, and appropriation of the funds referenced herein is subject to all federal, State, and local laws that regulate the use of such funds and the receipt of all necessary approvals, including, but not limited to the City Attorney. Section 5. The City Manager is authorized to make any changes to adjust, amend, and appropriate the City's Operating Budget, Five -Year Financial Plan, Strategic Plan, Multi -Year Capital Plan, and any other documents as necessary and applicable, pursuant to the provisions of this Resolution. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. Certain necessary actions by the City Manager and the designated City Departments to update the relevant financial controls, project close-outs, accounting entries, and computer systems in connection herewith are hereby authorized', ratified, approved, and confirmed. Section 7. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
