City of Miami Dear Mr, Padgett: I am in receipt of your letter dated April 17, 1978, regarding the above -captioned matter, copies of which letter have been distributed to members of the Commission and to the Legal Department. I have requested both Messrs. Joseph Grassie, City Manager, and George Knox, City Attorney, through their respective staffs, to prepare recommended changes in the Civil Service System. Once this is accomplished, I will call for a series of pub- lic hearings to get public input into the matter. Thereafter, I will request in- put from employees. Subsequently, I will ask for a joint meeting of the Civil Service Board and the City of Miami Commission to discuss the various approaches. It would be my hope that some change can be initiated through open, frank discus- sions, and that definitive conclusions can be reached between the Civil Service Board and the City of Miami Commission. However, if this is not the case; and provided the City Commission majority agrees with the proposed changes, we may have to go to the electorate for Charter changes. Therefore, the steps to be taken would be: 1) Review and recommendations from the Administration and Law Departments. 2) Public Hearings. 3) Input from the various unions and employee organizations. 4) Civil Service Board and City of Miami Commission action. 5) If the Civil.Service Board does not concur, and the City of Miami Commission in its majority wishes to make changes, it must be placed on the ballot this Fall. Krause, Director Department of Human Resources March 31, 1978 Progress Report on Affirmative Action In accord with our new Affirmative Action Plan, I am submitting our first semi-annual report prepared by the Affirmative Action Office and other staff in the Department of Human Resources. This memo is intended to high -light the major elements of our first report. Attachments II-A,B,C, & III show overall changes in the composition of the City's work force during 1977. Anglo employment declined from 54.4 per cent to 50.1 per cent; black employment increased from 28.1 per cent to 29.8 per cent; Latin employment increased from 17.4 per cent to 19.9 per cent; employment of other minorities in the City's work force re- mained at less than one per cent; and female employment increased from 17.1 per cent to 18.8 per cent. Attachment II-A,B, & C also contain data by salary levels. For e-'ployees earning over $20,000 per year, Anglo employment declined by 1.6 per- centage points; black employment increased by one percentage point; Latin employment increased by 0.4 percentage point; and female employment in- creased by 0.1 percentage point. While these are not major increases in top jobs, they indicate the beginning of a process toward more equitable employment patterns. Attachment IV-D shows a total of 465 new hires for the last six months of 1977. These break down to 20 per cent white, 45 per cent black, and 35 per cent Spanish. Thirty-three per cent of the total were female. Attachment VII-B shows 71 promotions for the period July -December 1977. These break down to 15 per cent Anglo males, 25 per cent black males and 23 per cent Latin males. Thirty-seven per cent of the total were female. Attachments I-A,B,C, & D contain basic data on the labor force in the City of Miami and in Dade County. Attachment I-D shows educational achievements for the total population and for the black and Spanish populations; Attach- ment I-C reports the employment status for these same groups and for females. Comparing the City's work force in Attachment III with labor force data in Attachment I-C indicates the following: MEW MEE sew NNE MM Joseph R. It is clear that blacks are currently underutilized in professional jobs and that Hispanic workers are underutilized in all of the above occupations. While these findings may be attributed in part to the low turnover in City employment, they indicate the magnitude of the problem of achieving a more representa- tive work force. Despite the relatively low level of female employment in professional, administrative, and service jobs in the City government, these patterns are consistent with the City's.labor market data. On the other hand, there appears to be an underutilization of women in protective services and technical jobs. Comparisons of the work force with educational levels in the City's labor market indicates additional areas of underutilization of black and Latin workers in technical positions and protective services (comparing City employment to the percentage of high school graduates in the labor market); no underutilization of black or Latin workers in paraprofessional positions (comparing City employment to the percentage of persons with 1-3 years of high school in the labor market); and an underutilization of Latin workers in service/maintenance jobs (comparing City employment to persons with elementary education in the labor market). These comparisons, while not as precise as the others, are indicative of the problem of achieving a more representative work force. This can be attributed in large part to the inclusion of CETA workers in reporting both new hires and promo- tions, Progress among classified positions is not as successful. Attachment XIII indicates that our only current progress in test valida- tion is the work by the University of Chicago under the Cohen Decree, The City has not yet begun any validation work to comply with the USA Decree issued March 29, 1977, However, on March 23, 1978, the City Commission passed an Emergency Ordinance approving additional funds for the Department of Human Resources in order to create a Test Validation Section responsible for validating the selection procedures used by the City of Miami. In summary, the following factors appear most significant at this time: 1. The City has made notable progress in the employment of minorities and women during the past year. 2. With regard to the top jobs in the City (salaries above $20,000.00/year), there has been an increase of 32.25% in the number of blacks; 8.9% increase in the number of Latins; 3.7% increase in the number of women; and a re- duction of 1.73% in the number of Anglos. 3. The City is meeting its goals under the Consent Decree, primarily due to the inclusion of CETA employees in the total data. 4. Greater efforts will be needed to improve our record of hiring and promoting women and minorities in the classi- fied service; in improving and validating our selection procedures to minimize adverse impact; and in expediting the selection of minorities and women in such occupational areas as skilled crafts, police and fire (protective services), technicians, professionals, and official/admin- istrator positions. These areas will receive continued attention during 1978. This report is submitted in accord with Section 13 of the Affirmative Action Plan, which provides for review by the City Manager and submission to the City Commission and the Affirmative Action Advisory Board. These are discrimination complaints based on race, color, religion, national origin, and sex as contained in Title VII of the Civil Rights Act of 1964.as amended. This Office also serves as a clear- inghouse for all types of complaints other than those contained in Title VII, whereas if the complainant's problem does not fall within the context of discrimination as described above, he is then counseled and referred to the proper office that has juris- diction on his particular case, such as, the City's Labor Relations Office, Civil Service Office, etc. The Affirmative Action Office also answers all types of questions that employees or applicants may have regarding equal employment opportunity, provisions of the Consent Decree, etc. During the past six months we have had all of the above described cases, some of which due to their brief and transient nature (non -complainants, looking for guidance only) are not logged or recorded. A number of the complainants of alleged discrimination brought to this office do have some basis to initiate an investigation. These may include formal complaints, in which the aggrieved person fills out and signs a complaint form and informal complaints, where the person wishes only to verbally state his grievance. In both instances the case is investi- gated and the results notified to the complainant. During the past six months this office has processed and logged twenty six cases, of these only three were job applicants, the rest being City employees. By City departments, there were six from Parks and Recreation, four from Stadiums and Marinas, four from Community Affairs, five from Police, one from Public Properties, one from Public Works, one from Building and Vehicle Maintenance, one from Management and Budget, two from Planning and one from Culmer Interim. The outcome of all these cases has been quite varied, depending on the nature of the complaint. The status of the six cases from the Department of Parks and Recreation is the following: after being terminated, one was granted a hearing at the Human Resources Department, and the decision by that Department is still pending; the second one was counseled and did not return, declining to sign form; the third case Vhas investigated, did not fill out form and did not return; the fifth one was counseled, was given form, did not return; and the sixth one was resolved and did not fill out or sign form. -1- -57- ATTACHMENT XII i II III tI'IYi''i li II � ��I�iIiYllII�IIIII�I I�i�Ylll I III.I111 Il�I III IIII � IVI, .i l l I 114141,01411 FUNCTIONS OF AFFIRMATIVE ACTION 3PFICE I II ,I �I � a� IlI. 01111 Of the four cases from Stadiums and Marinas: the first one declined to fill out form, but requested a transfer and was referred to the Manpower Office; the second and third cases requested our assistance in having their positions audited; the fourth one was referred to the City's Labor Relaitions Office after it was determined that it was not of our jurisdiction. From Community Affairs, the first complaint was resolved through conciliation; the second was resolved through counseling; and the fourth case was referred to the Civil Service Office. Of the five cases from the Police Department: two were resolved; the third was assisted in requesting a transfer; the fourth one filled out and signed a complaint form, mainly to go on record, was counseled and did not return; the fifth one was referred to the Administrative Staff Office. The case of the complainant from the Department of Public Properties is still pending. The one from the Public Works Department was resolved, as was the one from Building and Vehicle Maintenance, and the one from Management and Budget. July 1, 1977 through December 31, 1977, the City of Miami's Department of Human Resources, in conjunction with the University of Chicago's Industrial Relations Center, has continued the validation of the selection proce- dures used in the Police Department. Emphasis during this period was placed in the development of a performance evaluation measure that could be used as a reliable criterion of performance.
