AN ORDINANCE AMENDING ORDINANCE NO, 6871,
THE COMPREHENSIVE ZONING ORDINANCE FOR THE
CITY OP MIAMI, BY CHANGING THE ZONING
CLASSIFICATION OP AREA NORTHWEST OF THE INTER=
SECTION OP N,W, 14TH TERRACE AND HIGHLAND
ROAD, BEING A PORTION OF TRACT "A", CARDIAC
HOSPITAL SUE (75-46) ALSO 1NOWN AS TRACT "D",
TENTATIVE PLAT NO. 935-A - "BISCAYNE CIVIC
CENTER PLAZA", FROM R-3 (LOW DENSITY MULTIPLE)
TO R,C (RESIDENTIAL OFFICE), AND BY MAt(ING THE
NECESSARY CHANGES IN THE ZONING DISTRICT MAP,
MADE A PART OP THE SAID ORDINANCE NO. 6871,
BY REFERENCE AND DESCRIPTION IN ARTICLE III,
SECTION 2 THtREOF; BY REPEALING ALL ORDINANCES,
CODE SECTIONS, OR PARTS THEREOP IN CONPLICT;
CONTAINING A SEVERABILITY PROVISION; AND BY
WAIVING THE REQUIREMENT OP READING THIS ORDINANCE
ON TWO SEPARATE DAYS BY VOTE OF NOT LESS THAN 4/5
OF THE MEMBERS OF THE COMMISSION.
WHEREAS, the Miami Zoning Board, at its meeting of
May 1, 1978, Item No. 10(a), following an advertised hearing,
adopted Resolution No. ZB 97-78 by a 7 to 0 vote (1 member absent),
recommending changing the zoning classification as hereinafter set
forth; and
WHEREAS, the City Commission after careful consideration
of this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
a change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Ordinance No, 6871, the Comprehensive Zoning
Ordinance for the City of Miami be, and the same is hereby amended
by changing the zoning classification of area northwest of the inter-
section of N.W, 14th Terrace and Highland Road, being a portion of Tract
"A", CARDIAC HOSPITAL SUB (75-46) ai.so known as Tract „A" , Tentative
Plat No, 935-A - "BISCAYNE CIVIC CENTER PLAZA", from R-3 (Low Density
Multiple) to R-C (Residential Office), and by making the necessary
changes in the zoning district map made a part of the said Ordinance
No, 6871 by reference and description in Article ill, Section 2 thereof.

herewith be, and the same are hereby repealed insofar Ad they are in
conflict.
Section 5. Should any part or provision of this ordinance
be declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole. 1
Section 4. The requirement of reading this ordinance on ,
ttao separate days is hereby dispensed with by a vote of not less than
4/5 of the Members of the Commission.

(a) Application for Change of Zoning Classification from
R-3 to R-C (Residential Office).
(b) Variance application to permit construction of the
Cardiology Learning Center and Simulation Laboratory
as part of the National Children's Cardiac Hospital
(NCCH) of the University of Miami School of Medicine
with 2.33' front yard (20' required) 28.77% adjusted
lot coverage (24.59% allowed) and 15 off-street
parking spaces for the new addition (24 o.s.p. spaces
required) and subject to and in conjunction with the
Change of Zoning of TRACT "D", T. P. 935-A.
Change of Zoning is needed for the erection of the
building and the building is needed to house the
research laboratory presently located at the
Alamo Building which is scheduled to be demolished.
(a) APPROVAL. The proposed rezoning from R-3 to R-C
conforms to the Comprehensive Neighborhood Plan and
to the Master Plan for Jackson Memorial Hospital.
(b) APPROVAL IN ACCORD WITH THE PLANS ON FILE, SUBJECT
TO' FINAL LANDSCAPE APPROVAL BY THE PLANNING DEPARTMENT.
The Master Plan for the hospital complex incorporates
all of the structures and all of the vehicular and
pedestrian trafficways into one site. Keeping this in
mind, the need for the requested lot coverage variance
can be virtually eliminated if the project is
evaluated in terms of the entire complex instead of
just as this particular building on its individual lot.

BOARD
Although this building might More ideally be located
in Closer proximity to the existing University teaching
facilities, off of 10th Avenue, what vacant land that
does exist there today has infect already been earmarked
for other development. Therefore, given the one site
which is available, the applicants have successfully
attempted to work within the constraints of the site.
The front yard variance is necessary for the preservation
of an existing stand of trees located north and west
of the proposed structure. The building has been
designed to face out onto this area.
Finally, the parking variance request can be justified
on the basis of the Master Plan. Although there
currently is an immense parking problem at the hospital
center, with the future transit station on l2th Avenue
and with the construction of Jackson's second garage
off of 10th Avenue, this problem will be greatly
lessened.
Recommended Approval in accord with Planning
Department recommendation, May 1, 1978.

An ORDINANCE to provide for this Change of Zoning has been prepared
