MENT PROGRAM; CONTAINING A REPEALER PROVISIoN
AND A SEVERABILITY CLAUSE,
WHEREAS, the City Commission adopted ordinance No.
8731 on December 16, 1977, establishing revenues and appropriations
for the City of Miami, Florida, for the fiscal year ending Septem-
ber 30, 1978; and
WHEREAS, it is now necessary to increase Law Department
appropriations in an amount of $10,000 in order to compensate said
Department for increased legal services resulting from the assign-
ment of members of the City Attorney's staff to render advice and
counsel to the Office of Community Development in the implementation
of the Community Development Program; and
WHEREAS, the transfer of the aforesaid funds represents
a proper expenditure on the part of the Office of Community Develop-
ment from 3rd Year Community Development funds;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance No. 8731, adopted
December 16, 1977, as amended, is hereby further amended in the

Transfer of CD Funds to
Law Department
(1)
Pursuant to a Memorandum of Understanding entered into between the
Planning Department, through its Office of Community Development,
and the Law Department, it was agreed that a staff attorney would
be designated to provide specific services to the Office of Community
Development and, in turn, the Law Department would be provided,
through a Budget transfer, compensation of $10,000 for said services
during the current fiscal year. Mr. Terry Percy, Assistant City
Attorney, has been designated as the primary CD Attorney. The expendi-
ture of approximately 60 of his time handling CD assignments, includ-
ing review and approval of contracts, property acquisition, and
general counselling to CD staff, together with the costs of secondary
personnel, document and support our herein request for the above trans-
fer, which is approximately 70% of Mr. Percy's annual salary expense
($15,008) .
Mr. Gunderson has informed us that the requested transfer of 3rd Year
Community Development Funds from the properly coded account into the
General Fund for the Law Department can be completed administratively.
Mr. Thomas of the CD Office has advised us that the correct code is
00-2582, Index No. 21S602 (Contractual Services). I have therefore
prepared an approval signature line at the bottom of this memorandum
for Mr. Thomas' Office to demonstrate approval of the herein transfer
which represents an expenditure of his Office for accounting purposes.
In view of the above, I am forwarding for consideration by the Com-
mission, the attached copy of a proposed ordinance increasing the Law
Department appropriation by the amount of $10,000, which ordinance has
been prepared with the assis tan' e of Mr. Cahn of the Department of
Management and Budget.
