HomeMy WebLinkAboutR-78-03641-11111 firt (01111111111 MEM MEW gack erfi RESOLUTION NO. 7 8- 3 64 A RESOLUTION GRANTING A ONE YEAR EXTENSION OF THE VARIANCE AS LISTED IN ORDINANCE NO. 6871, ARTICLE IV, SECTION 17, TO PERMIT EXTENSION OF EXISTING WALL TO BE 10' HIGH (8' PERMITTED), BEING 5' FROM THE REAR PROPERTY LINE, ON LOT 4, BLOCK 3; BAY HEIGHTS (50-93), BEING 58 SAMANA DRIVE; ZONED R-1 (ONE FAMILY); GRANTED BY ZONING BOARD RESOLUTION NO. ZB 179-77. WHEREAS, ARTICLE XXXI of the Comprehensive Zoning Ordinance No. 6871, permits an extension of a Variance by the City Manager with approval by the City Commission, for a period of one year; and WHEREAS, the City Manager recommends a one year extension of the Variance granted by the Zoning Board by Resolution No. ZB 179-77; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a one year extension of the Variance as listed in Ordinance No. 6871, Article IV, Section 17, to permit extension of existing wall to be 10' high (8' permitted), being 5' from the rear property line, on Lot 4, Block 3; BAY HEIGHTS (50-93), being 58 Samana Drive; Zoned R-1 (One Family), granted by Zoning Board Resolution No. ZB 179-77, be and the same is hereby granted. ENCLOSURES: BAY I EI C HPS (50-9 Block 3, Lot 4 58 Samaria brive ARTICLE XXXI of the Comprehensive Zoning Ordinance No. 6871 provides that any Variance shall ex:Dire six months after the effective date of the Variance unless a Binding Permit or a Certificate of Use has been issued based upon the Variance. The Ordinance further provides that the City Manager may, after review and determination that sub- stantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the Variance for an additional period of time not to exceed one year, subject toapproval of the City Commission. This Department finds no objection to the granting of the extension of time for this Variance. We are requesting the City Attorney's office, by copy of this memo, to prepare the proper Resolution for this extension. cc: Law Department Planning Department Tentative City Commission date: May 10, 1978.
