A RESOLUTION GRANTING A PETITION FOR A PLANNED
AREA DEVELOPMENT (PAD) CONSISTING OF 37 NEW
ONE -FAMILY DWELLING STRUCTURES PLUS ONE EXISTING
STRUCTURE FOR A TOTAL OF 38 SINGLE FAMILY
DWELLING STRUCTURES ON THAT PART OF LOT "A"
LYING EAST OF MAIN HIGHWAY: AY: E ANTON HEIGHTS
(B-52) AND A PORTION OF QUINTA MARINA (34-45)
AND ALSO A PARCEL OF FILLED LAND BEING A
PORTION OF, AND THE SOUTH ASTWARDLY EXTENSION
O1' LOT "A", EWANTON HEIGHTS, BEING 3645 1A.a.N
HIGHWAY, AS PER PLANS ON FILE, SUBJECT TO
REPLATTING AND THE RECORDING OF SAID REPLAT
PRIOR TO COMMENCEMENT OF CONSTRUCTION: AND
SUBJECT TO THE TERMS AND CONDITIONS AS HEREIN-
AFTER SET FORTH.
WHEREAS, the Miami Zoning Board, at its meeting of
arc 6, 1978, Item No. 3, following an advertised Hearing,
ado_ ted
Resolution No. ZB 48-78 by a 7 to 0 vote (1 member
absent) recommending approval of a Planned Area Develop.re-
(PAD) as hereinafter set forth; and
WHEREAS, the City Commission finds that the application
.meets all of the standards for PADS set forth in the Comprehen-
sive Zoning Ordinance; and
WHEREAS, the City Co..ission finds that the PAD meets
all of the standards for a Conditional Use as outlined in
ARTICLE XXXII of the City Comprehensive Zoning Ordinance; and

WHEREAS, the City Commission deems it advisable in
the best interest of the general welfare of the City of Miami
and its inhabitants to grant the petition for the application
of a Planned Area Development (PAD), subject to certain conditions
hereinafter set forth,
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE E CITY OF MIAMI, FLORIDA:
Section 1. The petition for a Planned Area Development.
(PAD) consisting of 37 new one -family dwelling structures plus
one existing structure for a total of 38 single family dwelling
structures on that part of Lot "A" lying east of Main Highway,
EWANTON HEIGHTS (B-52) and a portion of OLINTA MAR)EA (34-45)
and also a parcel of filled land being a portion of, and the
southeastwardly extension of Lot "A", EWANTON HLIGHTS, being
3645 Main Highway, as per plans on file. subject to replatting
and the recording of said replat, as per plan accepted, prior
to commencement of construction; and subject to the following:
(1) A 20 foot set back from the property
abutting the platted area on the
northerly perimeter and no structures,
temporary or permarent, shall be placed
within said set back area.
(2) The lot coverage shall not exceed
40% of the lot area. The minimum
air cor d:.tioned space for any structure
shall not be less than 2500 square feet
nor more than 4,000 square feet.
(3) No fill shall be permitted which will
increase the existing elevation of any
portion of the platted property for
purposes of determining the height of
the structure.
(4) No structure shall exceed 35 feet in
height above the existing elevation of
the subject property and no structure
shall contain more than two levels of
living area. The height may be measured
to the meen roof elevation provided that
the attic or roof structure shall not
be utilized for residential purposes or
living quarters.

(5) The cut de sac located easterly of
tot 19 shall be relocated not less
than 40 feet south from the northerly
perimeter boundary line adjacent to
the easterly front Portion of tot 19.
(6) That the roadway shall be as shown on
revised plat filed this date commencing
at the westerly front of tot 12 as it
proceeds in a northerly direction.
(7) The paved roadway in front of the manor
house as it runs parallel to the northerl
boundary line shall set back from said
boundary lire a minimum of 12 feet.
(3) That said set back area shall have
planted greenery not less than 10 feet
in height and of sufficient depth to
screen any noise or light from inter-
fering with the peace and enjoyment of
the abutting property owners to the
north.
(9) Maintain the existing coral rock wall
on the northerly perimeter of the
property.
(10) That the following lots 1, 2, 3, 5
6 and Lots 12, 13, 14, 15, 16, 17,
& 18 shall have a minimum square feet
per lot of 10,040. Lots 4 and 19
shall have a minimum lot size of
10,200 square feet. Lot 7 shall have a
minimum lot size of 9,600 square foot.
(11) The wall on Bain highway shall be no
more than 4 feet high.
(12) An agreement in compliance with
Article XXI-I, Section 5§ (f) of
the Zoning Ordinance No. 6871 of
the City of Miami which shall include
the restrictions as contained in this
resolution and shall be subject to
the approval of the City Attorney as
a condition to the acceptance of the
tentative plat.
(13) That included by reference herein is
the site development information and
architectural features and materials
as contEined in the proposed planned
area development as submitted by the
applicant and those terms and conditions
as imposed by the Planning Department
not in conflict with the above para-
graphs (1) through (12) as per site
plan dated 4-27-78.
(14) Individual site plan approval by
Urban Development Review Board
and the Planning Department, Zoned
R-1B (One Family) as per ordinance
No. 6871 Article XXI-1.
(15) The plans on file as referred to herein
shall be considered exhibits (A) through
(D ) , on file with the City of Miami
Planning Department and Department of
Administration for Planning and Zoning
Boards.

APPROVAL BY URBAN DEVELOPMENT REVIEW BOARD AND
THE PLANNING DEPARTMENT; AS PER ORDINANCE NO. 6871,
ARTICLE XXI-1, ZONED R-1B (ONE FAMILY).
WHEREAS, the Miami Zoning Board, at its meeting of
March 6, 1978, Item No. 3, following an advertised Hearing, adopted
Resolution No. ZB 48-78 by a 7 to 0 vote (1 member absent) recommending
approval of a Planned Area Development (PAD) as hereinafter set
forth; and
WHEREAS, the City Commission finds that the application
meets all of the standards for PADS set forth in the Comprehensive
Zoning Ordinance; and
WHEREAS, the City Commission finds that the applicant
has followed all of the procedures and submitted all of the documents
necessary in accordance with the Comprehensive Zoning Ordinance; and
WHEREAS, the City Commission finds that the PAD meets all
of the standards for a Conditional Use as outlined in ARTICLE XXXII
of the City Comprehensive Zoning Ordinance; and
WHEREAS, the City Commission deems it advisable in the
best interest of the general welfare of the City of Miami and its
inhabitants to grant the petition for the application of a Planned
Area Development (PAD);
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1, The petition for a Planned Area Development

existing structure for a total of 38 single family dwelling structures
on that part of Lot "A" lying east of Main Highway, EWANTON HEIGHTS
(B-52) and a portion of QUINTA MARINA (34-45) and also a parcel of
filled land being a portion of, and the southeastwardly extension of
Lot "A", EWANTON HEIGHTS, being 3645 Main Highway, as per plans on
file, subject to replatting and the recording of said replat prior
to commencement of construction; and subject to the road having a
45 degree angle at the main house, the wall on Main Highway being
no more than 4 feet high, and individual site plan approval by Urban
Development Review Board and the Planning Department, zoned R-1B
(One Family), be and the same is hereby granted.
