CLAUSE, WHEREAS, the City further desires to 3.mprove the efficiency and adaptability of the sale of parking spaces at the Miami Orange Bowl Memorial Stadium for the variety of types, sizes, and admission -fee categories of events capable of using the stadium; and WHEREAS, present ordinance provisions, as written, are too rigid to permit adaptability to varying circumstances of event type, size, or admission -fee; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Subsections (b) and (c) of Section 39-24, of the Code of the City of Miami, Florida, as amended, are hereby further amended to read as follows: "Sec. 39-24(b) The per event schedule of parking charges shall be as followws: (1) For NFL professional football games; college season, post -season playoff, or "Bowl" football games; professional soccer games; and college season or post -season playoff soccer games; charge is $3.00, including state sales tax, per passenger car, per event, for parking on all city - owned parking lots, (2) For high school events, 50C, including state sales tax, per passenger car, per event, for parking on all city -owned park- ing lots, (3) Pot an events, ditief thaf football, the chatge per passenger car, pet event, including state sales tak, oh ail city owned parking tots is dependent Upon the average cost of admission to the event, as follows; AVer.age Admission .Cost Charge $6.00 or taore,..►►►:►......,.....$3.00 $5.00 to $5,99...............►...$2.50 $ 4 . 0 0 to $ 4 . 9 9 . . . . . , . . , , . . ► . ► , . ► , $ 2 , 0 0 $3.00 to $3.99....►.,....,..,►4,,$1450 $2,00 to $2.99...................$1.00 tess than $2.00.....,,,,,►.►►,.,.SOrR The parking charge for any event trust be sufficient, however, to ensure that total city parking revenues are not less than the cost of operating the parking lots for that event. If revenues are less than costs then the event sponsor shall reimburse the city for the difference. (4) $5.00 includes state sales tax per bus for parking on all city -owned parking lots at all events for which admission is charged. (c) No complimentary parking tickets will be issued. Nothing in this section shall be construed, however, as prohibiting the parking of cars of officials and employees whose presence may be required for the proper operation of stadium events. Further, nothing in this section shall affect the right of the City Commission to reduce or waive the parking fees for bona fide public purpose, religious, or charitable events, or for other events where no admission is charged. When parking fees are waived, either the event sponsor can pay parking attendants directly or the sponsor must reimburse the city for any costs incurred by the city in operating the parking lots." Section 2. All ordinances, or parts or ordinances, resolutions, or parts of resolutions, in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 3. If any sections, part of section, clause, phrase, or word of this ordinance is declared -invalid, the remain- ing provisions of this ordinance shall not be affected, PASSED ON FIRST READING BY TITLE ONLY this23 day of March , 1978. "DOCJ(f"iDEX T E vl NJ, I, ePvcs r ic. 27,42 1 ° 2 TO: Joseph R, Orassie City Manager r•aor,: De ennings D rector ent of adiums & Marinas March 3, 1978 3,..; Amending Orange Fowl Parking Ordinance, Draft Amending Ordinance, The experience of a year of operation under the existing Ordinance No. 8648 now reveals a need for some modifications to the Ordinance to relieve its rigidity in some areas. The present Ordinance specified that the per -event parking charge for high school football and soccer events shall be 50d and all other events shall pay $3.00 for general admission parking. Section (b)(2) of the proposed Ordinance removes the words "football and soccer events" as they relate to high schools, and makes the parking charge 50d for all high school events (of any type). The present Ordinance also presently requires a $3.00 parking charge for general admission parking at all professional and college football and soccer events which, technically, would include even "scrimmages" by these teams. Since it is not believed that that was the City's intention, Sections (b)(1) and (b)(3) have been modified to allow the City Manager judgmental latitude in such instances. The present Ordinance also presently requires a $3.00 parking charge even for events where no admission charge is charged to enter the event. Section (c) of the present Ordinance has been modified to allow the City Manager to exercise judgment in these areas also, provided, however, that an event sponsor shall be required to reimburse the City if parking revenues are less than the cost of parking lot operations.
