A RESOLUTION RELATING TO THE WAIVER OF
USE OR RENTAL FEES BY THE CITY COMMISSION
FOR CITY FACILITIES OR PROfERTIESIREQUIRING
A FINANCIAL ACCOUNTING BY THE USER OF SAID
FACILITIES WHERE ADMISSION FEES ARE CHARGED
OR WHERE THE FACILITIES ARE USED FOR FUND
RAISING PURPOSES.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. At any time a request is made of the
City Commission for a waiver of rental or use fees for
public facilities owned and operated by the City of Miami
that cannot be granted administratively by the City Manager
because of admission fees being charged for admission to
the facility and because other funds are being raised by the
user, a detailed accounting of funds received and disbursed
will be required to be submitted to the City Manager within
30 days from the date of such use.
Section 2. The above financial accounting must
also include a statement of the manner in which net profits
are disbursed together with a statement of the sums so dis-
bursed.
Section 3. Anyone requesting a fee waiver hereunder,
is required to follow the application procedures required by
all other applicants desiring to use City facilities.

to Commission's Fee Waiver Policy

In the process of reviewing material concerning City Commission policies
that I will be assembling into a Commission Policy Manual, I noticed
that the Fee Waiver Policy approved as Resolution No. 77-126 on February
10, 1977 lacks an important element that the Commission may wish to add
to its current policy.
The Fee Waiver Policy has been in effect for more than a year and has
worked very well. This policy provides a procedure whereby the City
Manager is authorized by the City Commission to grant fee waivers for
rental of City facilities if certain criteria are met. However, certain
requests for waivers of fees, not meeting these criteria, are granted by
the City Commission. On many of these, the City is foregoing receipt of
revenue while the requesting organization is raising funds by charging
admission or through other devices. Since this represents a de facto
contribution to the organization from the City, it seems quite proper
that the City receive an accounting of the disposition of all funds
raised at the event for which fee waivers are granted.
The proposed addition to the Commission's Fee Waiver Policy is the last
paragraph on the attached policy statement. Also included in this para-
graph is a stipulation that organizations being granted fee waivers under
circumstances where admission is being charged or funds are being raised
be required to follow the same application and investigation procedures
that are required of all other applicants desiring to use City facilities.

CITY OF MIAMI
COMMISSION POLICY
SUD ECT:
..............
A policy concerning requests for waiver of fees for the use of public facilities
owned and operated by the City of Miami.
PURPOSE:
To uniformly administer the numerous requests for waiver of fees, to assist the
City in conforming to existing laws, to encourage activities which benefit the
community, and to assist charitable and non-profit organizations, within legal
limits, in worthwhile undertakings.
POLICY:
In order to accomplish these purposes, the Miami City Commission declares that
all requests for waiver of fees for the use of public facilities shall be handled
administratively through appropriate City departments, with final determination
of these requests to rest with the City Manager. The City Manager will deny
requests for waivers of fees, unless any one of the following criteria is
found to exist. In that case, he may grant the requested fee waiver.
1. Where the project, event or activity serves a public purpose
by reason of significant positive impact upon the cultural and/
or economic well being of the citizens and where either (1) no
admission is to be charged patrons of the event, project or
activity; or (2) funding provisions have been specifically pro-
vided in the annual appropriations ordinance.
2. Where the request for the waiver of the fee for the project,
event or activity originates from an agency or instrumentality
of the United States Government, the State, County, or any other
municipality and this activity is not a part of the normal or
routine operations of such agency or instrumentality.
3. Where the requesting organization is a private or public charity
upon whose governing body the City of Miami has representation
and where such charity has filed with the City Manager a detailed
financial report :showing all receipts and disbursements for the
twelve month period preceding the request for Waiver of fees.
When the City Commission grants fee waivers for events at which admission fees
are charged and other funds are raised, those fee waivers shall carry with them
the requirement that a detailed accounting of funds received and disbursed must
be submitted to the City Manager within thirty days of such events. This
financial accounting must also include a statement of how net profits are
distributed and in what amounts. It is also the policy of the City Commission
that all organiations receiving fee waivers be required to follow the same
application and investigation procedures as all other applicants desiring
to use City Facilities.
