The major uncompleted work is that of landscaping, together with corrections, touch-up and clean-up throughout the park. Liquidated damages of $100 per calendar day have been in ffect since December 10, 1977. The contract bid was $427,651.00 of which $406,088.Oo has been completed. To date the contractor has been paid $365,479.00 and there is a retainage of $40,609.00 held by the City. The contractor is of the opinion that he can complete all work by March 31, 1978 except for the planting of 24 Black Olive trees. These Black Olive trees were located, tagged and approved on March 14, 1977. They will require four weeks for root pruning and will be installed prior to the end of April, 1978. Both the consultant and the project coordinator will recommend substantial completion, thereby stopping liquidated damages when all of the work has been completed, inspected and approved except for the planting of the 24 Black Olive trees around the periphery of the basketball court. The following is a list of uncompleted work: 1. Landscaping - A meeting was held on Monday, March 13, 1978 in order to expedite the completion of landscaping. This meeting was attended by the consultant, project coordinator, contractor, landscaping subcontractor and representatives of both the Parks Department and the Planning Department. On Tuesday, March 14, 1978, the consultant, the contractor, the landscaping subcontractor and representatives of both the Parks and the Planning Departments spent a full day in the field tagging and approving acceptable landscaping material. It is expected that all landscaping items will be installed prior to March 31, 1978, with the exception of 24 Black Olive trees. 78-189 Joseph Rs Orassie March 17y 1978 The contractor has also agreed to do the following landscaping items: a. Remove the existing and unacceptable Ficus, Black Olive and Poinciana trees in the basketball court and elderly recreation areas, b. Plant additional plants in landscaping beds to get the specified spacing between plants. c. Fill in joints and provide top soil dressing for existing sod that has been displaced. d. Replace three dead Bottle Brush trees and stake down other trees. e. Add soil in fern planting beds. f. Regrade berms around amphitheatre area to specified elevations prior to planting. In addition, the contractor will be required to do the following work: a. All countertops and benches must be sanded smooth or properly coated with an approved material. b. Wooden playground equipment must be sanded smooth to eliminate splinters and metal bars on playground equipment must be reworked to eliminate rough edges. c. The missing Concession Stand gate must be reinstalled properly. d. The pump for the Fountain which was specified too large must be replaced with a smaller pump. e. Replace hinges on all trash receptacles with stronger hinges. f. Provide insulation in ceilings of the buildings as specified. g. Provide base cover plates on all light poles and properly aim all lights. Minor corrections, touch-up and clean-up throughout park. Although the contractor has reinstalled a fence around the park and a Security Guard has been provided, these efforts have been insufficient to prevent residents of the neighborhood from using the park, The contractor has been notified that he bears full responsibility for replacing any damaged items and for any liability claims due to accidents in this park. The consultant's report on his inspections of March 13, 1978 are more in detail on uncompleted work and should be received very shortly. Copies will be hand delivered to your office when they arrive.
