A RESOLUTION AUTHORIZING THE DIRECTOR OF
FINANCE TO PAY SHIRLEY JACKSON AND FIREMANS
FUND INSURANCE COMPANY WITHOUT THE ADMISSION
OF LIABILITY, THE SUM OF $ 4,390.00 IN
FULL AND COMPLETE SETTLEMENT OF ALL BODILY
INJURY, LOSS OF USE, AND AUTOMOBILE COLLISION
DEDUCTIBLE CLAIMS AND DEMANDS AGAINST THE
THE CITY OF MIAMI, UPON THE EXECUTION OF
A RELEASE, RELEASING THE CITY OF MIAMI FROM
ALL CLAIMS AND DEMANDS, AND TO PAY TO FIREMAN'S
FUND INS. Co. WITHOUT THE ADMISSION OF
LIABILITY, THE SUM $ 500.00 IN FULL
AND COMPLETE SETTLEMENT OF TIIEIR PERSONAL
INJURY PROTECTION LIEN AND COLLISION
SUBROGATION CLAIMS AND DEMANDS AND THEIR
PERSONAL INJURY PROTECTION LIEN CLAIMS AND
DEMANDS AGAINST THE CITY OF M IAM I , UPON
THE EXECUTION OF A RELEASE, RELEASING THE
CITY OF MIAMI FROM ALL CLAIMS AND DEMANDS.
WHEREAS, SHIRLEY JACKSON a single individual filed a
claim against the City of Miami for the alleged bodily injury, loss
of use, and automobile property damage claims and FIREMANS FUND
INSURANCE CO. filed a claim against the City of Miami for an
alleged personal injury protection lien, resulting from an accident
involving a City owned vehicle on August 10, 1976, at or near
N.W. 14th St. and N.W. 3rd Ave., Miami, Florida.
WHEREAS, the above claim has been investigated by the
Torts Division of the City Attorney's office in accordance with
Ordinance No. 8417, which creates the City of Miami's Self -Insu-
rance Program, and said office recommends that these claims be
settled for the sum of $4,340.00and $500.00 respectively;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:

Section 1, That the Director of Finance is hereby
authorized to pay to SHIRLEY JAACKSON, without the admission
of liability, the sum of $4,390,
in full and complete set-
tlement of all bodily injury, property damage claims and
demands against the City of Miami, upon the execution of a
Release, releasing the City of Miami from all bodily injury,
Property Damage claims and demands.
Section 2. That the Director of Finance is hereby
authorized to pay FIREMANS FUND INSURANCE CO. without the
admission of liability, the sum of $500.00
in full and
complete settlement of personal injury protection lien, claims
and demands against the City of Miami, upon the execution of a
Release, releasing the city of Miami from all personal injury
protection liens, claims and demands.
PASSED AND ADOPTED this 23day of March , 1978.

Shirley Jackson, through her Attorney, has filed a bodily injury,
loss of use, personal injury protection lien, and automobile
collision claim.
Fireman's Fund Insurance Company has filed a personal injury
protection lien, which was negotiated for settlement by the
claimant's Attorney.
This accident occurred on August 10, 1976 at about 12:10 P.M.,
at or near N.W. 14th Street Und Third Avenue, Miami, Florida.
The claimant's vehicle was eastbound on N.W. 14th Street, and
stopped for a red light at N.W. Third Avenue, Miami, Florida.
The Police vehicle was directly behind claimant's vehicle and
was unable to stop in time to avoid a rear -end collision with
claimant's vehicle.
Shirley Jackson received a hiatus hernia and a cervical spine
sprain, and upon completion of medical treatment, was given a
ten to fifteen percent permanent partial disability.
Ms. Jackson is a private nurse and had a wage loss of $212.00,
which was verified. The total medical expenses, including three
days in the hospital was $2,825.30.
The personal injury protection lien can be settled for $500.00.
The bodily injury claim can be settled for $4,390.00. This is
to include settlement of any and all claims.
The above claim has been investigated by the Torts Division
of the City Attorney's office, in accordance with Ordinance
8417, which creates the City of Miami's Self -Insurance Program,
and said office recommends that the City of Miami pay to
Shirley Jackson the sum of $4,390.00, and $500.00 to Fireman's
Fund Insurance Company for full settlement of outstanding claims.
