THEREOF; RY REPEALING ALL ORDINANCES, CODE
SECTIONS, OR PARTS THEREOF IN CONFLICT;
AND CONTAINING A SEVERABILITY PROVISION,
WHEREAS, the Miami Planing Advisory Board at its meeting
of January 4, 1978, Item No. 3, following an advertised hearing,
adopted Resolution No, PAB 2-78 by a 6 to 0 vote recommending a
change of zoning classification as hereinafter set forth; and
WHEREAS; the City Commission, after careful consideration
and due deliberation of this matter, deems it advisable and in the
best interest of the City of Miami and its inhabitants to grant
said petition:
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive Zoning
Ordinance for the City of Miami be, and the same is hereby amended
by changing the zoning classification of Lots 1-4 & E23.4' of Lot 5,
Block 2; ROYAL GARDENS (20-3) and Tract "B" less E155' of S89.03';
ST. HUGH PARISH 1ST ADDITION (84-16), being approximately 3353-
3389 and 3400-3444 Franklin Avenue, from R-2 (Two Family) to R-1
(One Family); and by making the necessary changes in the Zoning
District Map made a part of the said Ordinance No. 6871 by
reference and description in Article III, Section 2 thereof.
Section 2, That all laws or parts of laws in conflict
herewith be, and the same are hereby repealed insofar as they are
in conflict,

and
TRACT 'B' less the E 155' of the S 89. 03', ST.
HUGH PARISH 1ST ADDITION. (84-16)
Consideration of amending the Comprehensive Zoning
Ordinance 6871 by changing the zoning classification
of the property (above), located in Coconut Grove,
from TWO FAMILY DWELLING -R-2 DISTRICT to
ONE FAMILY DWELLING = R 1 DISTRICT, all as
recommended in A Planning Study for Coconut Grove.
To bring two housing sites into conformity with
previous area -wide rezoning from R-2 to R-1,
making them non -conforming.
A Planning Study for Coconut Grove, approved in
concept by the City Commission (Resolution 74-1043:
dated September 23, 1974), recommended that all
of South Grove, south of Charles Avenue, be desig-
nated as low density/one family (R-1, R-1B, R-PD).
In 1975, the area along Franklin Avenue was rezoned
from R -2 to R -1 (Ordinance 8393: dated April 22, 1975)
except for these two sites. At the time of that public
hearing, representatives of the Dade County Department
of Housing and Urban Development and the Model City
Development Corporation stated that they had been
seeking to develop federally -assisted low and moderate
income housing on these sites -Stirrup Grove Townhouses
for two years and to rezone the sites to R-1 woul halt the
projects. The Commission excluded the two sites from
the area -wide rezoning, reserving reconsideration at
a later date.
Sixteen townhouses have been completed, almost ready
for occupancy in the first phase and certain site impro-
vements have been installed and building permits are
being processed for 10 townhouses in the second
phase. Rezoning to Rx1 would make these sites
non=conforming, but consistent with pr'e""ious area,
wide rezoning.
