WHEREAS, the Miami Zoning Board at its meeting of January 9, 1978, Item No. 12(c), following an advertised hearing, adopted Resolution No. ZB 15-78 by a 7 to 0 vote recommending change of zoning classification as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration and due deliberation of this matter, deems it advisable and in the best interest of the City of Miami and its inhabitants to grant said petition: NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance for the City of Miami, be and the same is hereby amended by changing the zoning classification of + E5' of Lot 15 and all of Lot 16, Block 2, ALTA VISTA CORR. "DOJGDAS GARDENS HOUSING", with = 50' average width (60' required) in conjunction with T. P, #994=A. (C) Change of Zoning Classification Application as follows; C(a) from R -1 (One Family Dwelling) to R =4 (Medium Density Multiple) C(b) from R-2 (Two Family Dwelling) to 11=4 (Medium Density Multiple) (ID) Conditional Use Application to permit construction of a 9-story apartment building to be used as a part of the Miami Jewish Home and Hospital for the Aged, subject_ to the recording of T. P. #994-A. (E) Variance Application to permit construction of a 2-story storage building and a 9-story apartment building with a 28% lot coverage for Tracts "A" & "B" (27. 5% allowed) and subject to a Change of Zoning Classification on part of said Tracts "A" & "B" and the recording of T.P. #994-A. The sequence of applications, as indicated above, is the simplest way that the applicatn has to accomplish the replatting and the erection of the two structures. (A) APPROVAL IN ACCORD WITH THE PLANS ON FILE AND SUBJECT TO THE REQUIREMENTS OF THE PLAT COMMITTEE. (B) APPROVAL IN ACCORD WITH THE PLANS ON FILE AND SUBJECT TO THE FILING OF A WRITTEN AGREEMENT STATING THAT THE LOT KNOWN AS TRACT "C" WILL NOT BE FURTHER SUBDIVIDED. Although the proposed configuration of Tract "C" (50 ft. by 210 ft) does not meet the minimum standards PLANNING DEPARTMENT ZONING BOARD which require a 60ft, lot width, it would provide more than the required minimum area of 6,000 sq. ft, If this lot were to be subdivided in the future, however, it would not meet any of the tnininzutn standards. (C) APPROVAL IN ACCORD WITH THE PLANS ON FILE, The proposed zoning changes would put the development into one zone. This enables one to take a uniform and coherent look at the project in its entirety. (D) APPROVAL IN ACCORD WITH THE PLANS ON FILE AND SUBJECT TO THE SUBMISSION AND APPROVAL OF FINAL LANDSCAPE PLANS BY THE PLANNING DEPART- MENT. (E) APPROVAL IN ACCORD WITH THE PLANS ON FILE AND SUBJECT TO APPROVAL OF THE REQUEST S FOR ZONING CHANGES & A CONDITIONAL USE PERMIT. On 3/18/74 a variance was guanted permitting the construction of an addition onto the Douglas Garden home which exceeded the maximum allowable lot coverage by providing 30.9% coverage. In effect, if this project is allowed to expand via the zoning requests with the added lot area there will actually be a reduction in the coverage for the total lot. Deferred from the meeting of December 19 in order that the applicant can 1) meet with people in the neighborhood to explain the plans and 2) get together with the Depart- ment of Public Works to settle the question of safety access through the proposed closed section of NE 52 Street. Recommended APPROVAL, January 7, 1978, by a 7-0 vote.
