A RESOLUTION AFFIRMING THE ZONING BOARD GRANT OF
VARIANCE FROM ORDINANCE NO. 6871, ARTICLE IV,
SECTION 19(7) (a) & (b) AND ARTICLE VIII, SECTIONS
3(2)(d) & 5,TO PERMIT CONSTRUCTION OF AN APARTMENT
PROJECT CONSISTING OF 81 UNITS IN ONE STRUCTURE
ON LOT 1 INCLUDING THAT PORTION OF LOT 1 COINCIDENT
WITH THE NORTHERLY AND WESTERLY LINES OF TRACT C,
AND LOTS 2 AND 3 INCLUDING THAT PORTION OF SAID
LOTS COINCIDENT WITH THE NORTHERLY LINE OF TRACT C;
BLOCK 1; BISCAYNE ISLAND SUB (34-93) AND LOTS 50
AND 51, BLOCK 1; BISCAYNE ISLAND RESUB (40-34),
BEING 801 VENETIAN WAY, AS PER PLANS ON FILE, WITH

WHEREAS, the Miami Zoning Board, at its meeting of November
21, 1977, Item No. 2, following an advertised hearing, adopted
Resolution No. ZB 209-77 by a 4 to 3 vote granting a Variance as
hereinafter set forth; and
WHEREAS, neighborhood objectors have taken an appeal to
the City Commission; and
WHEREAS, the Commission, after careful consideration and
due deliberation of this matter finds that due to peculiar circum-
stances affecting these parcels of land, practical difficulties and
unnecessary hardships would impair the owner's right to the reason-
able use of the property without the Variance granted as hereinafter
set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE

VIII, Sections 3(2)(d) & 5 to permit construction of an apartment
project consisting of 81 units in one structure on Lot 1 including
that portion of Lot 1 coincident with the northerly and westerly
lines of Tract C, and Lots 2 and 3 including that portion of said
lots coincident with the northerly line of Tract C; Block 1;

also a 50' east side yard for the apartment building (70' required)
and a 1.51 Floor Area Ratio (1.10 permitted); zoned R=4 (Medium
Density Multiple) and subject to: 1) applicant posting a bond with
the Department of Public Works for the improvement of the street
and the cul-de-sac, and 2) construction of a wall adjacent to the
Silverberg residence, be and the same is hereby affirmed.

Variance application to permit construction of an apartment
project consisting of 88 units in one structure on above site,
as per plans on file, with the parking structure occupying
23. 55 ; of the lot (20";_ allowed), a 22' side yard (45' re-
quired) and a 5' front yard (20' required) for such a
structure; also a 56' east side yard for the apartment
building (70' required), and a 1.64 floor area ratio (FAR)
(1.10 maximum allowed)
The developers propose to build 88 units of a larger size
and because of this, they claim they need the increased
FAR. The developers also stated that the variance for
the parking structure is needed "in order to provide inaxi-
mum landscaping and green areas" and to accomodate the
required parking.
DENLAL: No hardship exists to justify the requested
variances as a structure could be built within the the pro-
visions of the zoning ordinance. The variances with respect
to the parking structure are not of significant concern, but
the floor area ratio variance exceeds reasonable limits for
this type of bulk control.
