A RESOLUTION GRANTING A ONE-YEAR EXTENSION OF
THE VARIANCE FROM ORDINANCE NO, 6871, ARTICLE
XXIII, SECTION 4, TO PERMIT CONSTRUCTION OP A
BUILDING TO BE USED FOR WHOLESALE SALES ON
LOTS 21 AND 22 LESS WEST 13`, BLOCK 1;
COMMERCIAL BUENA VISTA (14-56), BEING 3801
N.E. 1ST AVENUE, WAIVING THREE OF FIVE REQUIRED
OFF-STREET PARKING SPACES, SUBJECT TO PROVIDING
THREE OFF -SITE PARKING SPACES WITHIN 300` OF
SUBJECT PROPERTY AND RECORDING COVENANT TO RUN
WITH THE LAND, AS PER PLANS ON FILE; ZONED C-5
(LIBERAL COMMERCIAL), GRANTED BY ZONING BOARD
RESOLUTION NO. ZB 161-77,
WHEREAS, Article XXXI of the Comprehensive Zoning
Ordinance No, 6871 permits an extension of a variance by the
City Manager with approval by the City Commission, for a one-
year period; and
WHEREAS, the City Manager recommends a one-year
extension of the variance granted by Zoning Board Resolution
No. ZB 161-77;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The request for a one-year extension of
the variance as listed in Ordinance No. 6871, Article XXIII,
Section 4, to permit construction of a building to be used for
wholesale sales on Lots 21 and 22 less West 13', Block 1;
COMMERCIAL BUENA VISTA (14-56), being 3801 N.E. 1st Avenue,
waiving three of five required off-street parking spaces, subject
to providing three off -site parking spaces within 300' of subject
property and recording Covenant To Run With The Land, as per
plans on file; zoned C-5 (Liberal Commercial), granted by
Zoning Board Resolution No. ZB 161-77, be and the same is hereby
granted.
PASSED AND ADOPTED this 16th day of March, 1978.

XXCI of the Comprehensive Zoning Ordinance No. 6871 provides
that any Variance shall expire six months after the effective date
of the Variance unless a Building Permit or a Certificate of Use ha:
been issued based upon the Variance. The Ordinance further provides
that the City Manager may, after review and determination that sub-
stantial progress has been achieved by the applicant in terms of
project planning, extend the expiration date of the Variance for an
additional period of time not to exceed one year, subject to approval
of the City Commission.
This Department finds no objection to the granting of the extension
of time for this Variance.
We are reauestinq the City Attorney's office, by copy of this memo,
to prepare the proper Resolution for this extension.

Dear Mr. Grassie:
This law firm represents Mr, Austin F. Bernstein in connection
with his development of a decorator showroom structure in the Cite
of Miami.
On Septenber 26, 1977, the City of Miami :zoning Board Adopted
Resolution No. ZB 161-77, granting my client a viri:rnce rrlat ing to
off -site parking requirements on the subject property. Enclosed
please find a copy of notification from the Ilepartment of Administration,
Planning and Zoning Boards, dated October II, 1977, If you tit i 1l notice,
the variance expires on lurch 26, 1978, r,nle s rr building permit is
issued by that date.
My client intends to apply fur a building per;Ii t for the structure
on or before March 26, 1978, however, the building permit obviously will
not be issued by the expiration date.
The subject property is located in Miami's well 1.nor.n ''lk'curator's
Row", and my client intends to build a decorator -hcnt ro1,nr to house a
national furniture or furnishings manufacturer or dirt rit•,rtor. My client
has been negotiating with several reputable perspective tenants, in his
attempt to provide a quality addition to one of '1iami's commercial aurae

tion areas. Mr. Bernstein has also been negotiating for financing for
the new structure and unfortunately local lenders will not entertain an
application for such financing until my client presents a signed lease
agreement or letter of intent with such a quality tenant,
