THE VARIANCE FROM ORDINANCE No, 6871, ARTICLE
Vitt, SECTIONS 3(2)(a)(b), TO PERMIT CONSTRUCT
TION OF A TWO-STORY DUPLEX RESIDENCE ON LOT 1,
BLOCK 5, ROSELAWN PARK (9=121), BEING 126-28
NE 76TH STREET, AS PER PLANS ON FILE, WITH A
5' SOUTH SIDE YARD (9' REQUIRED) AND 10' NORTH
SIDE YARD (15' REQUIRED); ZONED R=4 (MEDIUM
DENSITY MULTIPLE), GRANTED BY ZONING BOARD
RESOLUTION NO, ZB 144-77.
WHEREAS, Article XXXI of the Comprehensive Zoning
Ordinance No. 6871 permits an extension of a variance by the
City Manager with approval by the City Commission, for a one-
year period; and
WHEREAS, the City Manager recommends a one-year
extension of the variance granted by Zoning Board Resolution
No. ZB 144-77;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The request for a one-year extension of
the variance as listed in Ordinance No. 6871, Article VIII,
Sections 3(2)(a)(b), to permit construction of a two-story
duplex residence on Lot 1, Block 5, ROSELAWN PARK (9-121), being
126-28 NE 76th Street, as per plans on file, with a 5' south
side yard (9' required) and 10' north side yard (15' required);
zoned R-4 (Medium Density Multiple), granted by Zoning Board
Resolution No. ZB 144-77, be and the same is hereby granted.
PASSED AND ADOPTED this 16 day of March, 1978.

ARTICLE XXXI of the Comprehensive Zonind Ordinance No. 671 provides
that any Variance shall expire it month; fter the effective cate
of the Variance unless a Buildinc Permit or a Certificate of has
been issued based upon the Variance. The Ordiarce further nrovdes
that the Citp Manager may, after review -Ind aetermination that Hub-
stantial progress has been achieved by te r1T-Ticant in terms
project planning, extend the expiration date ot' the Vnriance f.. - nn
additional period of time not to exceed ono year, subject to n—,rovnl
of the City,Commission.
This Department finds no objection to the crantin,7 of the exte!1:,ion
