A RESOLUTION GRANTING A VARIANCE FROM ORDINANCE
NO, 6871, ARTICLE IV, SECTION 3(2)(a), TO FERMI
CONSTRUCTION OF A SINGLE FAMILY RESIDENCE ON LOT
13 LESS W6', BLOCK 10; SEVILLE (12-68), BEING
N.W. CORNER OF S.W. 17TH TERRACE AT 14TH AVENUE,
AS PER PLAN ON PILE, WITH A 10.5' STREET SIDE
YARD (15' REQUIRED) AND PERMITTING A 10.7% (6')
LOT LINE ADJUSTMENT (10%=5.6' PERMITTED) , CRE-
ATING A PARCEL 45.42' X 109.17'; ZONED R-1
(ONE FAMILY) .
WHEREAS, the Miami Zoning Board, at its meeting of
February 13, 1978, Item #1, following an advertised Hearing,
adopted Resolution No. ZB 41-78 by a 4 to 3 vote denying a
variance as hereinafter set forth; and
WHEREAS, the applicant has taken an appeal to the City
Commission; and
WHEREAS, notwithstanding the denial of the Zoning Board,
the City Commission, after careful consideration and due delibera-
tion of this matter, finds that due to peculiar circumstances
affecting this parcel of land, practical difficulties and unneces-
sary hardship would impair the right to the reasonable use of the
property without the variance granted as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE,COMMISSION OF THE
CITY OF MIAMI, FLORIDA: ITEM NO
Section 1. A variance from Ordinance No. 6871, Article
IV, Section 11(2) and Article V, Section 3(2)(a), to permit con-
struction of a single family residence on Lot 13 less W6', Block
10; SEVILLE (12-68), being N.W. corner of S.W. 17th Terrace at
14th Avenue, as per plan on file, with a 10.5' street side yard
(15' required) and permitting a 10.7% (6') lot line adjustment
(107-5.6' permitted), creating a parcel 45.42' x 109.17'; zoned
R-1 (One Family), be and the same is hereby granted.

EXPLANATION The house on the adjacent Lot (14) encroaches on Lot 13
and after the permitted 106:0 lot line adjustment, there is
a 4.8 inches encroachment present, which makes this
Variance necessary.

DENIAL. The proposed lot line adjustment will not improve
the existing conditions. The house which is currently on
the lot would still be too close to the property line to permit
an adequate distance between it and the proposed house (only
a 5.6' space). This space is not sufficient to provide adequate
light and air.
Deferred from the meeting of January 23 for the purpose of having
the applicant submit revised plans which include providing a 25 ft.
front yard and a side yard of 10 feet.
DENIAL. The original residence was situated in such a way as
to make use of both of these lots. Although the revised drawings
do provide more space between the existing and proposed buildings,
there still is inadequate space on this site for an additional unit.
With the lot line shift, Tract B contains only 4796 square feet
whereas the minimum footage for a new R -1 lot is 6, 000 square
feet.
