HomeMy WebLinkAboutO-087731tVd/ tb J/7/78 ORDINANCE NO4 8773 AN EMERGENCY ORDINANCE AMENDING SECTION 4 oP ORDINANCE NO, 8757, ADOPTED ON SECOND AND PINAL 1t1AD1NG ON VEBRt1ARY 23, 19/8, ENT1TLEDt "AN ORDINANCE AMENDING St cT1ONS 16=2 Att 16-3 OF THE CODE or THE CITY OF MIAMI, t'LORtDA, 1N THEIR ENTIRETY RELATING TO THE ROTATION OF CHtckIt4G ACCOUNTS, THE PRORATION OP TIME DEPOSITS AND KIND OF SECURITY BY ESTABLISHING A COMPETITIVE BID BASIS tOR AWARD OF THE CITY' S BAU1CING SERVICE NEEDS FOR A CON., TRACTUAL THREE-YEAR PERIOD, RESTRICTING INVESTMENTS TO BE PLACED ON A COMPETITIVE BID BASIS, AND CONTAINING A REPEALER CLAUSE AND A SEVERABILITY PROVISION AND CONTAINING AN EFFECTIVE DATE." 13Y CORRECTING THE EFFECTIVE DATE OF MARCH 1, 1978 CONTAINED THEREIN BY REASON OF A SCRIVENER'S ERROR AND PROVIDING FOR A NEW EFFECTIVE DATE OF APRIL 1, 1978. WHEREAS, the City Commission amended the City Code as a result of its review of a proposed Cash Management Program for the City of Miami; and WHEREAS, it was necessary to rescind Code Sections 16-2 and 16-3 relating to the City's banking services in order that the proposed Cash Management Program be implemented; and WHEREAS, the substituted provision of Code Sections 16-2 and 16-3 were not to become effective until April 1, 1978; and EREAS, Ordinance No. 8757 which enacted the substituted code sections provided that March 1, 1978 be the effective date instead of fkpri1 1, 1978 through a scrivener's error; and WHEREAS, it is necessary to immediately correct the a`nresaid scrivener's error by passage of the herein ordinance; NOW, THERRFORE, 13E IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1, Section 4 of Ordinance No, 8757, adopted on second and final reading on February 23, 1978, entitled; "AN ORDINANCE AMENDING SECTIONS 16-2 AND 16-3 OF THE CODE OF THE CITY OF MIANI, FLORIDA, IN THEIR ENTIRETY RELATING TO THE ROTATION QF C1I Cl IN(. The provisions of this ordinance shall become effective on Fieiveh-F0948 April1, 1978." Section 2. This ordinance is hereby deciated to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 3. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission.
