A RESOLUTION DISCONTINUING THE AUTHORITY TO
ACQUIRE EQUIPMENT ITEMS FROM MOTOROLA
COMMUNICATIONS AND ELECTRONICS, INC,, UNDER
RESOLUTIONS NOS, 41100 AND 421446 AND ACKNOWLEDGING
THE VALIDITY OF ALL PRIOR ITEM ACQUISITIONS
PURSUANT TO SAID RESOLUTIONS; FURTHER AUTHORIZING
THE OPEN SOLICITATION OF COMPETITIVE BIDS FOR
FURNISHING SUCH RELATED ITEMS IN THE FUTURE,
WHEREAS, Resolution No, 41100, pasSed November 19, 1969,
authurized the acceptance ef Motorola's hid for certain electronic
equipment items and further authoried the City of Miami to enter
into a Lease Ay.-reement for such equipment; and
WHEREAS, Resclution No. 424L;( passed April "(r):?., 1971,
authoried addin of addinlal units .L 'The equipment items refer-

Clarification of Resolution
#41100, 11/19/64 & Resolution
#42446, 4/22/71 - Dquipment
Acquisition
Attached please find a proposed Resolution ratifying
acquisition of certain equipment by the Department of
Communications, pursuant to a Lease Agreement between
the City and Motorola Corporation dated November 21, 1969,
and Addenda thereto.
Resolution No. 41100, passed November 19, 1969, had
authorized the acceptance of Motorola's bid, and further
authorized the City of Miami to enter into the original
Lease Agreement.
Resolution No. 42446, passed April 22, 1971, authorized
the adding of additional units to the items shown in the
original Resolution, pursuant to the terms of the Lease.
The Resolutions and the Lease with Addenda were construed
at that time to permit unlimited addition of units specified
at the price established by bid, in addition to the quantity
of units specified in the authorizing Resolutions. However,
it is recognized at this time that the enabling Resolutions
are ambiguous as to the quantity of equipment authorized to
be acquired.
Therefore, it is recommended that the acquisition of that
equipment not specifically listed in the Resolutions be
ratified by means of the attached proposed Resolution which
has been prepared by the City Attorney whose office has
assisted our department in this matter. Further acquisition
authority is being discontinued and City Commission authority
to solicit competitive bids for future acquisition is also
contained in the accompanying Resolution.
