HomeMy WebLinkAboutR-78-0161RESOLUTION NO. f n 1 G A RESOLUTION ACCEPTING THE PLAT ENTITLED BEGONIA VILLAS SECTION TWO, A SUBDIVISION IN THE CITY OF MIAMI, FL0M2IDA, AND ACCEPTING THE DEDICATIONS SHOWN ON SAID PLAT: AND ACCEPTING THE COVENANT TO RUN WITH THE LAND POSTPONING THE IMMEDIATE CONSTRUCTION OP FULL WIDTH IMPROVEMENTS ON S, W. 22 AVENUE UNTIL REQUIRED BY THE DEPARTMENT OF PUBLIC WORKS; AND AUTHORIZING AND DIRECTING THE CITY MANAGER AND THE CITY CLERK TO EXECUTE THE PLAT. WHEREAS, the City Zoning Board and the Department of Public Works have recommended the acceptance of the plat: NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Plat entitled BEGONIA VILLAS SECTION TWO being a resubdivision of Lots 14 and 15, less the west 12.5 feet thereof, Block D, Biscayne Park Terrace according to the plat thereof, recorded in Plat Book 2, at Page 36, of the Public Records of Dade County, Florida, which by reference is made a part hereof as if fully incorpora- ted herein and the dedications as shown thereon together with all exist- ing and future planting, trees and shrubbery on said property, to the perpetual use of the public, are hereby accepted and confirmed by the City of Miami, Florida. Section 2. The Covenant To Run With The Land executed by MICHAEL A. KURYLA AND HELEN M. KURYLA, his wife joined by C.L,M. DEVELOPMENT CORPORATION postponing the immediate construction of full width improvements until such time as required by the Department of Public Works of the City of Miami is hereby accepted and the proper officials are directed to record said covenant after Plat has been recorded in the Public Records of. The Proposed Record Plat entitled BEGONIA VILLAS SECTION TWO is a resubdivision of Lots 14 and 15, less the west 12.5 feet thereof, Blk, D, Biscayne Park Terrace (2=36), It will consist of four (4) lots zoned R-1. This plat is being forwarded to your office for City Commission Action. The attached detailed report from the Department of Public Works recommends the approval of the plat by the City Commission of Miami, Florida, and certifies its correctness as to form, Also attached are the following itemized papers necessary to present the Plat to the City Commission of Miami: Resolution accepting the Plat Print of proposed Record Plat Agreement form pertaining to subdivision improvements Covenant postponing immediate construction of certain subdivision improvements Opinion of Title Memorandum from the Department of Planning pertaining to landscaping requirements Memorandum from the Miami -Dade Water and Sewer Authority pertaining to water mains and appurtenances Portion of City Atlas Sheet No. 43 showing property platted colored in red WEP:WKB:met "SUPPORTIVE DOCUMENTS FOLLOW" THE CITY OP MIAMI, FLORIDA DEPARTMENT OF PUBLIC WORKS MARCH 9, 1078 REPORT OP PROPOSED RECORD PLAT OP BEGONIA VILLAS SECTION TWO A SUBDIVISION IN THE CITY OP MIAMI, PLORIDA * * * * * * * * * * * * * * * * * * * * The accompanying Plat entitled BEGONIA VILLAS SECTION TWO was prepared by Alfred J. Watson. It is in correct form for submission to the City Commission and is forwarded with a recommendation that it be approved. PERTINENT INFORMATION REGARDING THE PLAT: (1) The property platted is resubdivision of Lots 14 and 15, less the west 12.5 feet thereof, Blk. D, Biscayne Park Terrace (2-36). It will consist of four (4) Lots zoned R 1. (2) The location of the streets and the widths conform with the standards of the Department of Public Works of the City of Miami, Florida. (3) As certified to by Alfred J. Watson, , Registered Land Surveyor, this Plat complies with the plat filing laws of the State of Florida. (4) By authority of Resolution No. 177-77, adopted October 3, 1977, the Plat was recommended for acceptance by the City Zoning Board of Miami. (5) The attached Certificate of Title Examination dated November 10, 1977, signed by A. Chester Abney, Attorney, indicates that the fee simple title to the property platted is correctly vested in MICHAEL A. KURYLA and HELEN M. KURYLA and C.L.M. DEVELOPMENT CORPORATION and the Plat has been correctly executed. (6) The area platted is encumbered by a mortgage and the mortgage holder has executed the Plat and joined in its dedications. KURYLA and C.L.Mh DEVELOPMENT CORPORATION. This Cashier's Check has been deposited with the Director of Finance and will guarantee the completion of the subdivision improvements according to the provisions of the Agreement between The City of Miami and the afore- mentioned MICHAEL A. KURYLA and HELEN M. KURYLA and C.L.M. DEVELOPMENT CORPORATION. The improvements required at the property platted are listed as follows: Landscaping, Sidewalk, Grading and Shaping of Street Shoulder, Storm Drainage Structure, and Sanitary Sewers, (8) Since there is no full width improvements on S.W. 22 Avenue, in the vicinity of the property platted, it is recommended that the attached covenant be accepted postponing the immediate construction of these improvements until the area is more fully developed. (9) The Location of the property is shown colored in red on the accompanying mompanying copy of a portion of City of Miami Atlas Sheet No. (10) The attached Resolution has been prepared for the acceptance of the Plat by the City Commission of Miami, Florida.
