A RESOLUTION GRANTING A VARIANCE FROM ORDINANCE
NO, 6871, ARTICLE VI, SECTIONS 2(3), 3(3)(a),
TO PERMIT CONSTRUCTION OF A TWO STORY DUPLEX
ON LOT 13, CARA VILLA (32-12), BEING 3513 S.W.
17TH TERRACE, AS PER PLANS ON FILE, WITH 3,040
SQ. FT, 0F LOT AREA (4,000 SQ. FT. REQUIRED),
AND A 15' REAR YARD (20' REQUIRED); 20NED R-2
(TWO FAMILY) .
WHEREAS, the Miami Zoning Board, at its meeting of
November 21, 1977, Item ##1, following an advertised Dearing,
adopted Resolution No. ZB 208-77 by a 5 to 1 vote, denying a
variance as hereinafter set forth; and
WHEREAS, the applicant has taken an appeal to the City
Commission; and
WHEREAS, notwithstanding the denial of the Zoning Board,
the City Commission, after careful consideration and due delibera-
tion of this matter, finds that due to peculiar circumstances
affecting this parcel of land, practical difficulties and unneces-
sary hardship would impair the right to the reasonable use of the
property without the variance granted as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. A variance from
VI, Sections 2(3), 3(3)(a), to permit
duplex on Lot 13, CARA VILLA (32-12),
Ordinance No. 6871, Article
construction of a two story
being 3513 S.W. 17th Terrace,
as per plans on file, with 3,040 sq. ft. of lot area (4,000 sq.
required), and a 15' rear yard (20' required); zoned R-2 (Two
Family), be and the same is hereby granted.
PASSED AND ADOPTED this 23rd day of February
1978.

Variance application to permit construction of a two.
story duplex with 3,040 sq, ft, lot area (4,000 sq, ft.
required) and a 15, 0' rear yard (20' required).
The base building line reduces this lot by 9' leaving
a buildable area of 401 x 67' (original lot is 40' x 76').
If the applicant were to comply with yards as specified,
the buildable area would be further reduced to 30' x 271;
with the yard variance the buildable area woule be in.

the need for the second variance,
DENIAL: It is recommended that no more than one unit
be allowed. This block is already crowded and the approval
of the two units would only serve to overcrowd the area.
There would not be sufficient open space on this lot for two
units.
Deferred from the meeting of October 17 due to absence
of applicant.
Denied by 6-1 Vote November 21, 1977
On appeal, deferred for Commission to visit the area,
January 24, 1978
