A RESOLUTION GRANTING A VARIANCE FROM ORDINANCE
NO. 6871, ARTICLE VIII, SECTION 2(2)(a) AND
ARTICLE XXIII, SECTION 2(2), TO PERMIT MEDICAL
OR DENTAL OFFICES ON LOTS 7 AND 8, BLOCK 1,
HYDE PARK (11,-60), BEING 4370-72 WEST FLAMER
STREET, AS PER PLANS ON FILE, ON A LOT 50'
WIDE (100' REQUIRED) AND 5,000 SQ. FT, IN AREA
(10,000 S0, FT. REQUIRED), AND AN ACCESS AISLE
15' WIDE (23' REQUIRED) TO THE COMPACT CAR
SPACE TO THE REAR OF THE PROPERTY, IN CONJUNCTION
WITH CONDITIONAL USE APPLICATION; ZONED Ry4
(MEDIUM DENSITY MULTIPLE).
WHEREAS, the Miami Zoning Board, at its meeting of
September 26, 1977, Item No. 10(b), following an advertised hearing,
adopted Resolution No. ZB 160-77 by a 6 to 0 vote denying a variance
as hereinafter set forth; and
WHEREAS, the applicant has taken an appeal to the City
Commission; and
ItiTHEREAS, notwithstanding the denial of the Zoning Board,
the City Commission, after careful consideration and due deliberation
of this matter, finds that due to peculiar circumstances affecting
this parcel of land, practical difficulties and unnecessary hardship
would impair the right to the reasonable use of the property without
the variance granted as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI , FLORIDA:
Section 1. A variance from Ordinance No. 6871, Article
VIII, Section 2(2)(a) and Article XXIII, Section 2(2), to permit
medical or dental offices on Lots 7 and 8, Block 1, HYDE PARK (11-60),
being 4370-72 West Flagler Street, as per plans on file, on a lot
50' wide (100' required) and 5,000 sq. ft. in area (10,000 sq. ft.
required), and an access aisle 15' wide (23' required) to the com-
pact car space to the rear of the property, in conjunction with
Conditional Use application; zoned R-4 (Medium Density

Self-explanatory
DENIAL: The subject site is not of sufficient size to
accomodate the petitioned use and the parking necessary
for the use. The variance request for the aisle width is
in essence a waiver for required parking, as the reduced
aisle width would not provide convenient access to the
parking spaces. A reasonable use presently exists on the
site, commenserate with the size of the site.
Denied, September 26, 1977, by a 6 to 0 vote.
Deferred December 15, 1978
Deferred at the request of the applicant, January 24, 1978.
