NO, 6871 BY REFERENCE AND DESCRIPTION IN
ARTICLE III, SECTION 2 THEREOF; BY REPEALING
ALL ORDINANCES, COD SECTIONS, OR FARTS THEREOF
IN CONFLICT; AND CONTAINING A SEVERABILITY
PROVISION,
WHEREAS, the Miami Zoning Board at its meeting of
December 19, 1977, Item #10, following an advertised Clearing,
adopted Resolution No. ZB 238-77 by a 6 to 1 vote recommending
denial for a change of zoning classification as hereinafter set
forth; and
WHEREAS, notwithstanding the recommendation of the Zoning
Board, the City Commission, after careful consideration and due
deliberation of this matter, deems it advisable and in the best
interest of the City of Miami and its inhabitants to grant the zoning
change as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive Zoning
Ordinance for the City of Miami be, and the same is hereby amended
by changing the zoning classification of Lots 31 thru 40, Block 14;
BAYSHORE UNIT #4 (16-30), being the N.W. corner of N.E. 4th Court
at N.E. 55th Terrace, from C-1 (Local Commercial) to C-4 (General
Commercial); and by making the necessary changes in the Zoning
District Map made a part of the said Ordinance No. 6871 by reference
and description in Article III, Section 2 thereof.
Section 2. That all laws or parts of laws in conflict
herewith be, and the same are hereby repealed insofar as they are
in conflict,
Section 3. Should any part or provision of this ordinance
be declared by a court of competent jurisdiction to be invalid, the
same shall not affect the validity of the ordinance as a whole,

A Portion of this site is occupied by an appliance store
which will reamin as such. The rest is a former
Food Fair which the applicants intend to convert to a
packing plant for vitamin tablets and accessory offices.
DENIAL. Such a change in zoning is not consistent
with the General Plan which designates this area as a
Residential/Commercial Zone. The Land use in the
immdeiate area is predominantly commerical in nature
composed of C-1 uses. Although the land on the West side
of the F. E. C. railroad right-of-way is zoned C-5, it is
somewhat removed from the subject property by the phy-
sical separation of the R.O.W. The area accross Biscayne
B oulevard to the East which is considered to be a part of
this neighborhood, is zoned R-C and R-1.
An application was made on 9/29/62 to change the zoning
of several of these lots from C-1 to C-4. It was denied on the
basis that there was no apparent change in the character
or of conditions of this area to warrant such a change.
The same is true today.
