AN EMERGENCY ORDINANCE AMEttbtNG SECTIONS 2 AND 6 OP
ORDINANCE NO. W73i, ADOPTED DECEMBER i6, i977, THE
ANNUAL; APPROPRIATIONS ORDINANCE FOR Tt#E FtSCAtt YEAR
ENDING SEPTEMBER 20r 1975, AS AMENDED, BY INCREASING
THE APPROPRIATION FOR THE BtiIttbtNG AND VEHICLE
MAINTENANCE DEPARTMENT IN AN AMOUNT OF $`6 ,000;
DECREASING THE BUILDING AND VEHICLE MAINTENANCE
DEPARTMENT'S T'UND BALANCE BY THE SAME AMOUNT;
CONTAINING A REPEALER PROVISION AND A SEV`ERABIt,ITY
CLAUSE; AND DECLARING THIS ORDINANCE TO BE AN
EMERGENCY MEASURE.
WHEREAS, the City Commission adopted Ordinance No. 8731 on
December 16, 1977 establishing revenues and appropriations for the City
of Miami, Florida for the fiscal year ending September 30, 1978; and
WHEREAS, a need exists for expenditures for vehicle
replacement during fiscal year 1977-78; and
WHEREAS, an unallocated Fund Balance has been generated over
a period of years in the Intra-governmental Service Fund, Department
of Building and Vehicle Maintenance, through the sale of surplus
vehicles and through economies achieved by the Department; and
WHEREAS, said unallocated Fund Balance includes an amount
of S75,000, and can be used for vehicle replacement;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Section 2 of Ordinance No. 8731, adopted December 16,
1977, as amended, is hereby further amended, as follows:-1

"Section 2. The following activities, which are carried on
for the service convenience of other funds, shall be
operated by the city Manager within the limits of the
appropriations provided in the foregoing Departments, Boards,
and accounts of the City of Miami and other revenues or
receipts which may be received,

Section 3. All ordinances or parts of ordinances insofar as they
are inconsistent or in conflict with the provisions of this ordinance are
hereby repealed.
Section 4. If any section, part of section, paragraph, clause,
phrase, or word of this ordinance is declared invalid, the remaining provision
of this ordinance shall not be affected.
Section 5. This ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for the preservation of peace,
health, safety, and property of the City of Miami, and upon the further
ground of the necessity to make the required and necessary payments to its
employees and officers, payment of its contracts, payment of interest and
principal on its debts, necessary and required purchases of goods and supplies,
and to generally carry on the functions and duties of its municipal affairs.
** The source of these revenues are appropriations out of Departmental
and Enterprise Fund Budgets.

E. Cox0 birector of Building and Vehicle Maintenance, has anticipated use of
05,000 from the unallocated fund balance to fulfill the requirements for
vehicle replacements during fiscal year 1977-78,
The attached proposed ordinance would appropriate funds from the unallocated
fund balance of Building and Vehicle Maintenance for use in vehicle re-
placement,
