Section 16-5.5 of the Code of the City of Miami, Florida, is hereby amended by repealing said section in its entirety and substituting therefor the followings "16-5.5. Same --Cultural arts advisory committee established. An 'Arts In Public Places Committee' is hereby established whose members shall be appointed by the city commission. The committee shall consist of 5 individuals possessing a high degree of competence in the evaluation of sculpture, painting, artistic structural design, and/or other appropri- ate art media for display or integration in public places. (a) All nominations for membership on this committee shall be provided to the city commission by a 3-member nomin- ating panel, consisting of one representative of each of the following: the Cultural Executives Council, Inc.; the South Florida Chapter of the American Institute of Architects; and the Dade County Council of Arts and Sciences. (b) Persons wishing to nominate others for membership on the herein committee, or persons seeking to be nomin- ated themselves as committee members, :may furnish their names directly to the nominating panel, as well as to members of the city commission, who will forward said names to the nominating panel for a review and analysis of the qualifications of .those persons. (c) Anyone whose name is received by the nominating panel must agree to serve, if appointed, before he or she is nominated by the panel. (d) The 5 initial committee members shall be selected from a list of 10 nominees provided by the nominating panel. if the city commission appoints less than 5 committee members from such list, the panel will submit 2 addi- tional names for each membership vacancy remaining, In the event membership vacancies still remain, the panel will again submit 2 additional names for each membership vacancy, This process shall continue until all vacancies have been filled, 4141 (e) future seieetiang to fill vadaticies created by expiring terms shall be made by the city ccmmiasion from ,a list of names provided by the nominating panel consistitig of 2 nominees for each vaeatit Membership position. All such meetings are to be open to the public." Section 2. All ordinances or parts of ordinances, insofar as they are in conflict with the provisions of this ordinance, are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. This Ordinance has been amended to indlude a clause which will provide a method for City Comthissioners to submit to the 3-member nominating panel the names of individuals who they feel ate qualified to serve on the Art in Public Places Committee. The panel will review and analyze all submitted names and will recommend or not recommend these individuals for nomination to the Committee depending Upon the outcome of their review. This Ordinance, as amended by the City Commission, states that the Commission will be presented with two nominees for each position to be filled oh the Committee.
