WHEREAS, the Least Tarn:; gar' considered as an endangered species: and WHEREAS, Least Terns for the part several years have been nesting on Virginia Frey; and WHEREAS, there are projects scheduled which would interrupt their nesting period; and WHEREAS, an area on Virginia Key could be designated and set aside for this nesting period; and WHEREAS, some improvements will he made to this area by the 841st Engineering Battalion, U.S. Army Reserve. WHEREAS, the Least Tern Committee of Virginia Key will be responsible for any permits necessary for this work; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the area on the northeastern portion of the Marine Stadium site will be considered as a Least Tern Sanctuary for the nesting period in 1978. Section 2. The City Manager is authorized to allow the 841st Engineering Battalion to do the site work, subject to all proper permits being obtained by the Least Tern Committee. CI t y =t+4 at fi' �-'"' i � February 17, 19/8 Least Tern Sanctuary The City has been requested to establish a Least Tern Sanctuary on Virginia Key. The Least Terns are considered an endangered species. Virginia Key is a nesting area in South Florida. Generally, the birds arrive in the Miami area in April and remain until August. An area of City property on Virginia Key almost immediately across from the grandstand at the Marine Stadium has been requested by the Virginia Key Tern Committee as a sanctuary area, and we have been requested to allow the 841st Engin- eering Battalion to prepare the site for the birds arrival in April. It is my recommendation that the City Commission grant the Manager authority to allow the 841st Engineering Battalion to improve the nesting area and further, that this area be designated as a sanctuary without any restrictions, which would limit any use by the City. This will also enable us to proceed with the dredging project for the Port of Miami and will remove any question about depositing this material on the north end of the Key. It will be the burden of the Virginia Key Tern Committee to acquire any Department of Environmental Regulations or other agency permits. J C E. I have taken the liberty of drafting a letter (copy enclosed) for you to send as soon as approval is granted. This is to save'time because the engineering unit has a rather tight schedule and we hope to have the site prepared before the birds begin to arrive. Please feel free to make whatever changes you think are necessary.
