WHEREAS, the Miami City Commission approved Resolution No. 77-830 on N oVember 10, 1977, allocating $1,500 to be used in a mural painting project for certain buildings in Coconut. Grove, and; WHEREAS, the owners and/or lessees of the buildings have agreed to contribute $1,000 each for said project which is de- tailed in the attached AGREEMENT; NOW,THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The City of Miami accepts $1,000 from each of the building owners and/or lessees - Joe Avalos, Jerome D. Bryant, and Michael J. Samuels, these funds to be used in the Coconut Grove's Painted Architecture - Pilot Project according to the provisions of the attached agreement. Section 2. An additional sum of $3,000 is hereby al- located from the General Fund, Special Programs and Accounts, Quality of Life Program, Miscellaneous Account. Section 3. Homan February ''7, 1978 Coconut Grovels Painted Architecture Pilot Project Early in November of 1977, the City was approached by Mr Sandy MacNaughton, representing an organization called "Creative Currents," urging the City to support a mural painting project on three buildings in Coconut Grove. The City Commission approved an allocation of $ 1,500 for this project on Novem- ber 24, 1977, by Resolution 77-880 (attached). Since November, John Baratte, Director of the Miami Center/Lowe Art Museum, and I have been working with Mr. MacNaughton, the artist (Jon Soeder), the three building owners, the Coconut Grove Chamber of Commerce, and Mr. Ed Cox to produce a worthwhile and tasteful project. Since the original con- cept proved to be unacceptable to the Coconut Grove Chamber of Commerce, our staff, and certain of the owners, all of the participants have worked out an alternative design which has proven acceptable to all parties. The final design involves a style of painting called "trompe 1'oeil," which literally means "fool the eye," but in this case highlights archi- tectural features of the buildings, many of which aren't actually there but will be made to appear to be there. We feel that this project will greatly improve the appearance of these three buildings, which are the focal point of the Coconut Grove Business District. The present appearance is a schlocky display of home-made signs, peeling paint, and junky ad- vertising, along with some serious attempts at imaginative and creative design. To get away from this uncoordinated and crowded proliferation of signs and exterior decoration, this project establishes a model of taste and appropriate design that fits the Grove and enhances its image. The in- tent of this project, from the City's point of view, is to improve the Grove by encouraging businesses and business organizations to follow suit, using this pilot effort as an example of what can be done. This project is somewhat larger in scope than the project described to the City Commission in November. Besides the design, the principal difference is that the City will have complete control over the execution of the project. The project is described in detail in the attached agree- ment. The City Commission will be requested to approve the agreement, the receipt of $1,000 from each building owner/lessee, and the appropriation of another $3,000 from the "Quality of Life" Account to cover expenditures for city forces executing the project. WITIESSETH WHEREAS, the CITY and the OWNERS have agreed to pool cash and other resources in order to implement a project called "Coconut Grove's Painted Architecture * Pilot Project,"involving a face-lift and the pattern -setting harmonized design which will tie these three (3) buildings together in an attractive, tasteful and unique fashion; and WHEREAS, it is felt by the principals to this Agreement and by the Coconut Grove Chamber of Commerce that rather to continue an unplanned and independent proliferation of commercial signing building facades, this project could encourage and stimulate similar improve- ments throughout the Grove; and WHEREAS, the Coconut Grove Chamber of Commerce, in approving the project, its design and intent, hopes to demonstrate that some sort of standard or uniform design characteristics can be adopted and enforced throughout the Coconut Grove Business District, NOW, THEREFORE, in consideration of the mutual agreements hereinafter contained, the parties hereto agree as follows: THE CITY AGREES: 1. To provide funds in the amount Fifteen Hundred Dollars ($1500), pursuant to Resolution No. 77-880, in cash or in -kind services, plus an a6ditiona1 $ 3,000 in in -kind services for this project. 2, That it will have sole responsibility for and complete control over the execution of this project. 'Front right lower panel on Dade Cycle Building This will consist of a list of building's occupants. b. Lower left front panel of Dade Cycle Building This will read "Leatherbound." This sign may be replaced with _another sign, should Leatherbound vacate the premises and be replaced with another business, but that sign must conform in terms of lettering style, location, and size. c. Lower left front panel of Blue Water Marine Building v:`-) This will read "Nete-434merrs4.44s Travel Aosaa4This sign may be replaced with another sign, if the -OWNER so desires, but the new sign must conform in terms of lettering style, location, and size. d. Northeast corner (side wall) of I Ching Building This sign shall consist of a list of this building's occupants. Appendices "A", "B", "C", & "D" are hereby incorporated into this Agreement by reference, and any modification thereof must be in writing signed by the parties to this Agreement. Scheduling for work shall be at the discretion of the Director of Building and Vehicle Maintenance. OWNERS shall be responsible for removing all attached signs, awnings, wood panels and facades within forty-eight (48) hours notice from the Director of Building and Vehicle Maintenance, or his designated representative. The OWNERS agree to provide normal maintenance to the surface covered in the project and will repaint when necessary, using the same colors and patterns called for in the design for a period of Len (10) year following the execution of this Agreement. IT IS ALSO AGREED that no signs other than those called for in this Agreement will be attached to or painted on the surfaces of the building under each party's control for this ten (10) year period. Further, no other adornment, fixture, facade, or other physical alter- ation will be incorporated into the building surfaces covered in this Agreement without the approval of the City Manager. No permanent signs or other attractions that detract from the project's design motif shall be permitted outside or inside these buildingsupper story windows, where they are noticeable from the street. No permanent stands, display cabinets, or tables, or other exterior sidewalk objects other than those provided for below will permitted under the terms of this Agreement. "Permanent" shall apply to those tables, stands, or cabinets, placed in front of these buildings for longer than a two (2) week period. Those cabinets that are permitted are the two (2) display cases in front of Dade Cycle Building. Any changes or additions to any part of the front of these three (3) buildings must conform to the attached design and are subject to the approval of the City Manager. Awnings to be attached to these subject buildings must conform with the basic design motif of this proip i, sofas aas this does not conflict with existing agreements. Cash contributions by the OWNERS and the CITY will be deposited in a special account with the City of Miami following execution of this Agreement by the OWNERS and the CITY. The CITY shall rear:e no repairs or structural improvements to subject buildings beyond filling cracks, glazing windows and sealing surfaces in preparation for painting. These activities and the painting of the signs described in Appendicies "C" & "D" shall nstitu' e the limit of the CIT'Y'S work.
