A RESOLUTION TERMINATING THE OCTOBER 24, 1958
AGREEMENT WITH GRAND UNION SUPERMARKETS, INC.,
RELATING TO THE RIGHT OF THE CITY OF MIAMI TO
PURCHASE A PORTION OF PRIVATE PROPERTY FOR
OPENING N.W. 53 STREET BETWEEN 11 AND 12 AVENUES;
AND AUTHORIZING AND DIRECTING THE CITY MANAGER
AND CITY CLERK TO EXECUTE A DOCUMENT OFFICIALLY
TERMINATING SAID AGREEMENT
WHEREAS, City Resolution No. 27962, passed on December 21, 1955,
adopted the arterial street plan of the City of Miami, which designated
N.W. 53rd Street an arterial highway between N.W. 32nd Avenue and N.W.
2nd Avenue; and
WHEREAS, City Resolution No. 30390, passed and adopted November 5,
1958, authorized and directed the City Manager to enter into an agree-
ment with Grand Union Supermarkets, Inc., to convey to the City of
Miami the subject property, if and when it is determined by the City
of Miami to open N.W. 53rd Street on said tract of land, at a cost of
.59c per square foot; aid
WHEREAS, said agreement had been executed by both parties
October 24, 1958 and ,gas subject to the approval of Grand Unions
application for a zoning change causing that portion of property then
zoned as B-3 to remain in such classification and to have the remain-
der of the property which had been then zoned for residential purposes,
changed to a B-1 zoning to permit the land to be used for a shopping
center; and
WHEREAS, this approval was obtained by the passage and adoption

WHEREAS, this agreement was further conditioned upon N. W.
53rd Street being opened by the City of Miami as an arterial high.
tray by January 1, 19 75 ; and
WHEREAS, said date having passed and the City of Miami having
no present nor foreseeable future plans to open N.W.53rd Street,
the execution of a formal document officially terminating said
agreement has been requested; and
WHEREAS, the City of Miami having no reason to refuse this
request, it is now in order for the Commission of the City of Miami
to officially terminate the aforesaid agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The agreement with Grand Union Supermarkets, Inc . ,
dated October 24, 1958, and duly recorded on March 30, 1960 under
Clerk's File No. 60R-59484 of the Public Records of Dade County,
Florida, giving the City of Miami the right to purchase a portion
of land between N.W. llth and 12th Avenues, south of 54th Street,
legally described as being in Alecia Carey Homestead, Plat Book A,
Page 30, and the revised Plat of Miami, Home Addition, Plat Book 39,
Page 76, of the Public Records of Dade County, Florida, be and the
same is, terminated.
Section 2. The City Manager and the City Clerk of the City of
Miami, Florida are hereby authorized and directed to execute an
appropriate instrument terminating the aforesaid agreement for the
purpose of removing same of record.

Resolution Terminating
Grand Union a City Agreement
for opening N.W. 53 Street
; between 11 and i2 Avenues

On October 24, 1958 the City of Miami entered into at agreement with
Grand Union Supermarkets, Inc., which gave the right to the City to
purchase 38,354 square feet of land for the proposed opening of
N.W. 53rd Street between llth and 12th Avenues. The total purchase
price of this land was $22,628.86 (.59per square foot).
This agreement, (copy with drawing attached), was conditioned upon
N.W. 53rd Street being opened by the City as an arterial highway, as
designated by City of Miami Resolution No. 27962, on or before
January 1, 1975. It was also subject to the approval of the owner's
application for a zoning change causing that portion of the owner's
property then zoned as B-3 to remain in such classification and to
have the remainder of the property which had been then zoned for
residential purposes changed to a B-1 zoning, to permit the land to
be used for a shopping center. This latter condition was met by the
passage and adoption of City Ordinance No. 6272 on November 5, 1958.
Since the City of Miami has not opened the aforesaid street, and the
time to do so having expired by the terms of this contract, the
present owner has now requested that the aforesaid agreement be
officially terminated.
We concur with this request as there are no plans in the present nor
in the foreseeable future to open N.W. 53 Street. It is now in order
for the City Commission to terminate the abovementioned agreement.
THE DEPARTMENT OF PUBLIC WORKS RECOMMENDS ADOPTION OF THE ATTACHED
RESOLUTION FORMALLY TERMINATING THAT CERTAIN AGREEMENT WITH GRAND
UNION SUPERMARKETS, INC., DATED OCTOBER 24, 1958 GIVING THE CITY OF
MIAMMI THE RIGHT TO PURCHASE A PORTION OF LAND BETWEEN N.W. 11TH AND
12TH AVENUES, SOUTH OF 54TH STREET, LEGALLY DESCRIBED AS BEING IN
ALECIA CAREY HOMESTEAD, PLAT BOOK A, PAGE 30, AND THE REVISED PLAT

This letter is part of the agreement of purchase of land to contract
between the Orand Union Supermarket, Inc, and the City of Miami, and is written
for sale purpose of establishing that the cost of the land frrInt4r, Henry
Coppieger of that tract of land south of 54th Street, between llth and 12th
Avenues, Miami, Florida , is $0,59 per square feet, that when and if
the City of Miami should exercise the agreement to purchase said land, the
storesold price will be the cost to the City for the right,of-way needed to
open 1\1,14, 53rd Street,

Relating to purchase agreement for
opening; N, W. 53 Street between
llth and l2th Avenues
TIIIS INSTRU[ENT, made and executed this day of
1978, by THE CITY OF MIAMI, a municipal corporation of the State of
Florida
WITNESSETH;
WHEREAS, The City of Miami, Florida, a Municipal Corporation, and
Grand Union Supermarkets, Inc., as owner, did enter into that certain
agreement dated October 24, 1958, and recorded on March 30, 1960 under
Clerk's File No. 60R-59484, of the Public Records of Dade County,
Florida, which agreement relates to the property described therein;

WHEREAS, the option given by said agreement to The City of Miami
to purchase a portion of said owner's land for use as a public street
has expired, and the need for the agreement no longer exists;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That for and in
consideration of the sum of ONE DOLLAR and other good and valuable con-
siderations to it in hand paid, THE CITY OF MIAMI does hereby and here-
with release, relinquish and forever discharge Grand Union Supermarkets,
Inc., its successors or assigns, of and from the requirements of the
aforesaid agreement on the following described property:
That land lying between N.W. llth and 12th Avenues, south of 54th Street,
legally described as being in Alecia Carey Homestead, Plat Book A, Page
30, and the Revised Plat of Miami Home Addition, Plat Book 39, Page 76
of the Public Records of Dade County, Florida;
and hereby directs the Clerk of The Circuit Court to cancel the same
of record.
Approved and accepted on behalf of The City of Miami, Florida,
