Parkes, Director Department of Public Works .)Ar February 9, 1978 r'L£ 4384 OMNI HIGHWAY IMPROVEMENT H=.4884 Resolution Certifying The Pending Lien And Fixing The Amount Thereof On July 8, 1975 the City of Miami entered into an agreement with Omni International of Miami Ltd., a Florida limited partnership to construct certain street improvements for Omni International. The "City"agreed to construct said street improvements as a City Highway Project using Highway Bond Funds. "Omni" as the lessee of Tract "A" of the Omni International Subdivision had agreed to ray the "City" the full cost of the project including incidental-' expenses. On September 23, 1976 the agreement was approved by Resolution-<- No. 76-822 and authorization was given to expend $500,000 for the construction of subdivision improvements in the Plat entitled "Cmni International"and to collect said sum plus interest from Omni International of Miami Ltd. over a 10 year period, all in accordance with the agreement and letter amendments. Contracts were awarded for Bid "A" Highway, Bid "B" Drainage and Bid "C" Landscaping. The improvements consisted of clearing and grading, excavating and filling, construction of full width asphaltic, concrete pavement consisting of limerock base material, asphaltic birder, and surface courses; concrete curb and gutter, sidewalk, drainage structures and landscaping. The Construction of these improvements has been completed and the work accepted by the City Commission by Resolutions in September of 1977. A public hearing is scheduled for February 9, 1978 to hear objections to the certification of the pending lien and fixing the amount of said lien at $425,106.22, the first payment to become due and payable September 1978, and each payment due each September for the succeeding nine years, per Section II, paragraph 1 of the above mentioned -agree- ment. If no objections are sustained, it will be in order for the Commission to adopt the resolution certifying the pending lien, fixing the final amount, fixing the date of the first payment and each of the_ succeedin^; payments. .IF NO OBJECTIONS ARE SUSTAINED, THE DEPARTMENT OF PUELIC. WORKS RECOMMENDS THE ADOPTION OF THE ATTACHED RESOLUTION CERTIFYING THE PENDING LIEN FOR OMNI HIGHWAY IMPROVEMENT H-4384.
