A RESOLUTION AUTHORIZING THE DIRECTOR OF
FINANCE TO PAY TO JUAN BAUZA
WITHour THE ADMISSION
OF LIABILITY, THE SUM OF $ 9,000.00 IN
FULL AND COMPLETE SETTLEMENT OF ALL BODILY
INJURY, LOSS OF USE, AND AUTOMOBILE
PROPERTY DAMAGE CLAIMS AND DEMANDS
AGAINST THE CITY OF MIAMI, UPON EXECUTION
OF A RELEASE, RELEASING THE CITY OF
MIAMI FROM ALL CLAIMS AND DEMANDS, AND
TO PAY TO SENTRY INSURANCE, A MUTUAL
COMPANY, WITHOUT THE ADMISSION OF LIABILITY,
THE SUM OF $1,000.00 IN FULL AND COMPLETE
SETTLEMENT OF THEIR PERSONAL INJURY PRO-
TECTION LIEN CLAIMS AND DEMANDS AND THEIR
PERSONAL INJURY PROTECTION LIEN CLAIMS
AND DEMANDS AGAINST THE CITY OF MIAMI,
UPON THE EXECUTION OF A RELEASE, RELEASING
THE CITY OF MIAMI FROM ALL CLAIMS AND
DEMANDS.
WHEREAS, JUAN BAUZA, a single individual,
filed a claim against the City of Miami for the
alleged bodily injury, loss of use, and automobile property damage
claims and SENTRY INSURANCE, A MUTUAL COMPANY, filed a claim
against the City of Miami for a alleged personal injury protection
lien, resulting from an accident involving a City owned vehicle on
August 31, 1976, at or near S.W. 8th Street and S.W. 43rd Avenue,
Miami, Florida:
WHEREAS, the above claim has been investigated by the Torts
Division of the City Attorney's office in accordance with Ordiance
No. 8417, which creates the City of Miami's Self -Insurance Program,
and said office recommends that these claims be settled for the sum

of $9,000.00 and $1,000.00 respectively;

Section if That the Director of Finance is hereby authorited
to pay to jUAN BAUZA without the
admission of liability, the sum of $9,000.00 in full and complete
settlement of all bodily injury, loss of use, and automobile collision
deductible claims and demands against the City of Miami, upon the
execution of a Release, releasing the City of Miami from all bodily
injury, loss of use automobile collision deductible claims and
demands.
Section 2. That the Directcr of Finance is hereby authorised
to pay to SENTRY INSURANCE, A MUTUAL COMPANY without the admission
of Liability, the sum of $1,000.00 in full and complete settlement
of a personal injury protection lien, claims and demands against
the city of Miami, upon the execution of a release, releasing
the City of Miami, from all personal injury protection liens,
claims and demands.

Settlement of bodily injury,
property damage, and personal
injury protedton lien, by the
Claim of Juan Sauta and his
insurance carrier, Sentry
insurance, a Mutual Company
Juan Sauna has filed a claim against the City of Miami
Police Department through his Attorney, Lester Rogers,
involving bodily injury, property damage, and the insurance
carrier's personal injury protection lien, resulting from
an accident involving a City of Miami Police vehicle.
This accident occurred on August 31, 1976, at 5:37 P.M., at
or near S.SV. 8th Street and S.W. 43rd Avenue, Miami, Florida.
The City vehicle was southbound on S.W. 43rd Avenue, with its
operator intending to make a left turn to proceed eastbound
on 8th Street. The Police vehicle was controlled by a stop
sign. The city vehicle proceeded into the path of the claimant
vehicle, which was westbound in the left hand traffic lane.
Juan Bauza, the claimant owner and operator, is represented by
Attorney Lester Rogers.
The claimant's vehicle, a 1967 Mustang, was a constructive
total loss as a result of this accident. Net value-$431.00.
Injury consisted of an acute lumbar sprain, trauma to the
left lower leg, post traumatic headache, laceration to anterior
aspect of left lower leg, loss of consciousness, and trauma to
the head.

The personal injury protections lien in this particular matter
is collectible by the carrier.
The above claim has been investigated by the Torts Division of
the City Attorrney's office, and in accordance with Ordinance
No. 8417, which creates the City of Miami's vehicle self-
insurance program, and said office recommends that said claims
be settled for an amount of $9,000.00 towards the bodily injury
and property damage claim of Juan Bauza, and $1,000.00 for the
personal injury protection lien of Sentry Insurance, a Mutual
Company.
