RESOLUTION NO.
A RESOLUTION AUTHORIZING THE DIRECTOR
OF FINANCE TO PAY TO ROBERT BOLTON
WITHOUT
THE ADMISSION OF LIABILITY, THE SUM
OF $5,425,00 IN FULL AND COMPLETE
SETTLEMENT OF ALL BODILY INJURY,
PERSONAL INJURY PROTECTION LIENS, AND
PROPERTY DAMAGE, CLAIMS AND DEMANDS
AGAINST THE CITY OF MIAMI, AND UPON
EXECUTION OF A RELEASE> RELEASING THE
CITY FROM ALL CLAIMS AND DEMANDS.
WHEREAS, ROBERT BOLTON,
filed a claim against the City of Miami for alleged bodily injury,
personal injury protection lien, and Property Damage, resulting
from an accident, involving a City -owned vehicle on S.E. 8th St.
at or near S.E. 1st Ave., Miami, Florida:
WHEREAS, the above claim has been investigated by the Torts
Division of the City Attorney's office, in accordance with Ordinance
No. 8417, which creates the City of Miami's Self -Insurance Program,
and said office recommends that these claims be settled for the sum
of $5,425.00 respectively;
NOW, THEREFORE, , BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:

without the admission of liability, the sum of $5,425.00 in full
and complete settlement of all bodily injury, personal injury
protection liens, and Property Damage claims and demands against
the City of Miami, upon the execution of a release, releasing
the City of Miami from all bodily injury, personal injury protection
liens, and Property Damage claims and demands.

Settlement of Bodily Injury and
Property Damage Claims of Robert
Bolton.
D/A3 1/12/77.
p/A: S.E. 8th Street and 1st
Ave., Miami, Florida.
Mr. Robert Bolton has filed a bodily injury, and property claim
against the City of Miami, through his Attorney, Ellis Rubin B.A.
This accident occurred on January 12, 1977 at or near 5.E. 8th St.
and S.E. 1st Ave., Miami, Florida.
Mr. Bolton, was east bound on S.E. 8th Street in the right lane.
Approaching S.E. 1st Ave., the City vehicle was also eastbound in
the center lane S.E. 8th St., and made a right turn onto S.E. 1st
Ave., directly in front of Mr. Bolton.
As a result of the accident Mr. Bolton suffered a fractured wrist
and foot, also his vehicle, a 1975 Kawasaki, model HIF was a total
loss.
Mr. Bolton also lost 18 days fron work, which amounted to $598.50
in lost wages. These lost time and wages were verified by this
employer.
The total medical expenses are $606.50, lost time and wages $598.50
and the property damage of $925.00 or a total amount of special
damages of $2,130.00.
This claim can be settled for $5,425.00.
The above claim has been investigated by the Torts Division of the
City Attorney's office and in accordance with Ordinance No. 8417,
which creates the City of Miami Self -Insurance Program, and said
office recommends that the City of Miami pay $5,425.00 for settlement
of this claim.
