A RESOLUTION AUTHORIZING THE CITY MANAGER TO PURCHASE IN LIEU OF CONDEMNATION A FIVE (5) FOOT STRIP OF LAND COMPRISED OF 581 SQ. FT., LOCATED ON THE SOUTHEAST CORNER OF DOUGLAS ROAD AND MAIN HIGHWAY, MIAMI, FLORIDA, FOR THE SUM OF TWO THOUSAND FOUR HUNDRED TWENTY-TWO DOLLARS AND SEVENTEEN CENTS ($2,422.17), AND ALLOCATING TWO THOUSAND SIX HUNDRED ($2,600.00) DOLLARS FROM THE 1972 PARKS & RECREATIONAL FACILITIES G.O. BOND FUND TO COVER THE COST OF ACQUISITION OF FEE SIMPLE TITLE TO THIS PROPERTY AND OTHER COSTS INCIDENTAL TO THE ACQUISI- TION. WHEREAS, the property located on the Southeast corner of Douglas Road and Main Highway, Coconut Grove, Miami, Florida, is for the widening of the existing Bicycle Path; and proposed to be acquired WHEREAS, the Department of Parks & Recreation has approved the acquisition of this land to provide for the widening of the existing Bicycle Path in the area, and concurs with the recommendation to acquire this parcel; and WHEREAS, the necessary monies for said acquisition are available from Item 14, City Wide Park Equipment & Landscaping, of Paragraph F of the 1972 Parks & Recreational Facilities G.O. Bond Fund, all in accordance with Ordinance 8716, Capital Improvement Program; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF "DOCUMENT, , INDEX ITEM NO. ' " Section 1. The City Manager be and he is hereby authorized and directed to purchase a five (5) foot strip of land located on the Southeast corner of Douglas Road and Main Highway, Miami, Florida, legally described in metes and bounds, for the widening of the existing Bicycle Path, for the sum of $2,422.17. Section 2. That $2,600.00 be and it is hereby allocated from Item 14, City Wide Park Equipment & Landscaping, of the 1972 Parks & Recreational Pale 2, CITY COMMISSION MEETING OF JAN 3 4 978 w *1 ./ Facilities G•O. Gunderson /Director of Finance c R_i/IIt, fieq r:3: Copy of Resolution; Map with legal description By memorandum dated Match 3, 1977, authorization was given by the Director of Parks & Recreation Department, Mr. Al Howard, to begin the acquisition of approximately 5.51 strip of land on an arc, at the southeast corner of Douglas Road and Main Highway, Coconut Grove. The purpose of the acquisition of this approximately 581 square feet of property is to widen the existing bicycle path so as to afford better visibility. The pertinent facts of this acquisition are as follows: - Appraiser Fee. Atlantic Appraisal Associates, Inc. $300.00 Appraised Value of the Parcel Atlantic Appraisal Associates, Inc. (Note: Due to an incorrect legal description furnished to the appraiser the area was 227 sq. ft.. After correction, the area to be taken was increased to 581 sq. ft.) M/L Improvements Chain Link Fence, trees, shrubbery. A negotiated price of $4.17 per sq. ft. was agreed upon. Total Cost to acquire, $2,422.176 In addition, it was agreed that two (2) trees and some foliage would be relocated and a finished concrete block wall would be erected to replace the chain link fence. It is recommended that this parcel be acquired by negotiation rather than condemnation as this is a partial take and it would be more costly to the City to attempt to acquire by condemning.
