HomeMy WebLinkAboutR-78-0055RFC/ tb 1/18/78 "SUPPORTIVE DOCUMENTS FOLLOW" RESOLUTION NO, 4 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE ATTACHED AGREEMENT WITH METROPOLITAN DADE COUNTY RELATING TO THE MAINTENANCE OF THE BEAUTIFICATION OF SOUTHWEST EIGHTH STREET, WITH FUNDS THEREFOR ALLOCATED FROM THE 1ST YEAR FEDERAL COMMUNITY DEVELOPMENT BLOCK GRANT FUND. WHEREAS, the City of Miami has identified the maintenance of S.W. 8th Street as a Community Development Project pursuant to Resolution No. 182-77 adopted February 15, 1977 and Resolution No. 191-77 adopted September 6, 1977; and WHEREAS, Metropolitan Dade County has offered to enter into an agreement with the City of Miami to maintain the beautification of S.W. 8th Street; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The City Manager is hereby authorized to execute the attached agreement between Metropolitan Dade County and the City of Miami relating to the maintenance of the beautifi- cation of S.W. 8th Street in the City of Miami, with funds therefor hereby allocated from the 1st Year Federal Community Development Block Grant Fund PASSED AND ADOPTED this 244th day of January 1978. CITY COMMISSION MEETING OF JAI .3 4 1978 -55 ,tiiio 00. . ....,,. .,....,...,.•�,,..• Maintenance Agreement Relating To Beautification Ifnprovemehts of SW 8th Street This Agreement made and entered into this day f , 1978 by and between Dade County, a political subdivision of the State of Florida, hereinafter referred to as the "County" and the City of Miami, hereinafter referred to as the "City". WITNESSETH, that the County has entered into an Agreement with the City for the implementation of a Community Development Project pursuant to Resolution No. R-182-77 adopted February 15, 1977 and Resolution No. R-191-77 adopted September 6, 1977. WHEREAS, this Agreement is in full force and effect; and WHEREAS, the parties are desirous of entering into this Agreement to accomplish the purposes outlined in the above Agreements; NOW, THEREFORE, the parties hereto agree as follows: 1. In accordance with Section II, BEAUTIFICATION OF S.W. 8th STREET, of the City/County Agreement relating to Community Development activities which reads as follows: "Once the project is completed, the City will provide maintenance for all improvements not directly related to the street paving and traffic flow." City maintenance activities shall include but not be limited to: A. General Maintenance a. Street sweeping b. Litter pick up B. Landscaping Maintenance a. Trimming, insecticide spreading, fertilizing, and replacement of plant materials upon expira- tion of contractors warranties b. Irrigation and sprinkler systems (including hardware and water fees) ` SUPPORTIVE DOCUMENTS FOLLOW" C. Pedestrian amenities maintenance a: Shelters) benches, ornamental lighting, but not including the cost of electricity b. becorative enclosures for trash receptacles, newspaper racks, and traffic control boxes The City hereby agrees to indemnify, defend and hold harmless the County for any and all losses, claims, demand and/or law suits arising out of or in connection with the City's maintenance respon- sibilities as specified in this agreement. The County, as part of this Agreement, agrees to permit City inspection and approval of items for which it is responsible for maintenance prior to the County's acceptance of those items from the contractor. The County will notify the City in writing as to when the maintenance responsibility will begin. 2. Except for the modification as herein specified, all terms and conditions of the contract approved by Resolution Nos. R-182-77 and R-191-77 shall remain in full force and effect. ENCLOSURES: SW 8th gt, r The attached resolution should be placed on the City Commission Agenda for January 24, 1978 for their consideration. Several years ago the City agreed to maintain the beautification itriproVe- ments on SW 8th Street once the County had completed their capital investment. The County has completed their capital investment which is estimated at $1.2 million. The attached agreement formalizes our maintenance responsibilities. Attachment cc: Law Department 1: 8 - 5 5
