HomeMy WebLinkAboutO-08754ICA bit ORDINANCE NO 1 8` 5 4 AN ORDINANCE AMENDING ORDINANCE N0, 8871 THE COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF MIAMI BY CHANGING THE ZONING CLASSIFICATION OF W28' OF N144, SS' OF LOT 1 AND THAT PORTION OF LOT 2 LYING NORTH OF TRACT A NEW ROOSEVELT OFFICE SUB (104-50) AND THAT PORTION OF LOT 3 LYING NORTH OF N.W. NORTH RIVER DRIVE; PIRATES COVE SUB (1-92) BEING APPROXIMATELY 1751 N.W. NORTH RIVER DRIVE, FROM R-4 (MEDIUM DENSITY MULTIPLE) TO C-4(GENERAL COMMERCIAL); AND BY MAKING THE NECESSARY CHANGES IN THE ZONING DISTRICT MAP, MADE A PART OF THE SAID 'ORDINANCE NO, 6871, BY REFERENCE AND DESCRIPTION IN ARTICLE III, SECTION 2 THEREOF: 8Y REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT; AND CONTAINING A SEVERABILITY PROVISION. WHEREAS, the Miami Zoning board, at its meeting of November 7, 1977, Item No. 8, following an advertised hearing, adopted Resolution No. Zb 200-77 by a 7 to 0 vote recommending a change of zoning classification as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration and due deliberation of this matter, deems it advisable and in the best interest of the City of Miami and its inhabitants to grant a change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance for the City of Miami be, and the same is hereby amended by changing the zoning classification of W28' of N144.88' of Lot 1, and that portion of Lot 2 lying north of Tract A; NEW ROOSEVELT OFFICE SUB (104-50) and that portion of Lot 3 lying north of N.W. North River Drive; PIRATES COVE SUB (1-92), being approximately 1751. N.W. North River Drive, From R-4 (Medium Density Multiple) to C-4 (General Commercial.); and by making the necessary changes in the zoning district map, made a part of the said Ordinance No, 6871. by reference and description in Article III. Section 2 thereof, Section 2, That .all laws or parts of laws in conflict herewith be. and the same are hereby repealed insofar as they are in conflict. Section 3, Should any part or provision of thts ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a what. Applicant wants to increase its parking area. APPROVAL: This property was originally zoned C-4 and was rezoned to R-4 P.A. D. in order that a specific housing project could be developed. This project has never materialized and now it would be appropriate to rezone the land to C-4 once again. By changing the subject property to a commercial zone the properties to the east and west, which are zoned C-4, will form a contiguous zone. No negative impact is forseen for the surrounding area.
