HomeMy WebLinkAboutO-08737ORD2RA iCE NO, 8737 AN ORDINANCE PROVIDINO FOR THE HOLLIRO OF A SPECIAL BOND ELECTION IN THE CITY OP MIAMI, FLORIDA, ON MARCH 7, 1978, PROVIDING THAT THIS ORDINANCE SHALL 00 INTO EFFECT IMMEDIATELY UPON ITS ?ASSAM, AND DISPENSING WITH THE READING OF THIS ORDINANCE ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN POUR -FIFTHS OF THE COMMISSION, HE IT ORDAINED SY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Notice of the special bond election hereto- fore called by Ordinance No. 8737 to be held on Tuesday, March 7, 1978, shall be published in THE MIAMI NEWS and THE MIAMI HERALD, newspapers of general circulation pub- lished in the City of Miami, Florida, at least once each week for 4 consecutive weeks before said election, the date of the first publication in each of said newspapers to be at least 30 days before said election, which notice shall be substan- tially in the following form: NOTICE OF SPECIAL FOND ELECTION To Be Held On TUESDAY, MARCH 7, 1978 in THE CITY OF MIAMI, FLORIDA As provided by Ordinance No. 8737 , duly adopted by the Commission of The City of Miami, Florida, a special election will be held on Tuesday, March 7, 1978 for the purpose of submitting to the qualified electors of The City of Miami, Florida, the following question: Sha ,l bonds of The City of Miami, Florida, in an aggre- gate principal amount not exceeding ,$15 000,000 be issued under the provisions of Ordinance No. for the purpose of paying the cost of STORM SE MENTS in said City, such bonds to be issued at one time or from time to time and to mature in Annual installments 2 to 20year►s, inclusive, After the date of the respective bond:, to bear interest at a rate or rates not to exceed the rate provided for in the statutes of the State of Florida and to be payable from unlimited ad valorem taxes, Said ordinance provides that for the prompt paym nt of the principal of and the interest on such bonds there shall be levied and collected annually an ad valorem tax upon all taxable property within The City of Miami, over and above all other taxes authorised to be levied by said City, sufficient to pay such principal and interest as the same respectively become due and payable. The Commission of The City of Miami reserves the right to rake all or any part of such bonds redeemable prior to their respective maturities at such times and prices and under such terms and conditions as may be fixed by resolution prior to the sale of the bonds. The polls at said election will be open from 7'00 o'clock A.M. until 7:00 o'clock P.M. of the same day. The City of Miami shall be authorized to issue said bonds if the question for the issuance of said bonds shall be approved by a majority of the qualified electors of The City of Miami voting on such question. Said special bond election shall be held at the polling places in The City of Miami, in the several election precincts designated by the Board of County Commissioners of Dade County, as set forth below. Section 3. Since the City of Miami has established the per- manent regi3`ra Ion s;+stem under State l&w and the general election laws of the State require 14 days prior approval by the Board of County Commissiore•s of Dade County for acceptance of branch office registration and that the registration books be closed 3C days prior to the date of such special bend election, regis- tration for such special bond election shall be at the office of the Supervisor of Elections of Dade County, 140O Biscayne Boulevard, Mimi, Florida. Section u. Said special bond election shall be held at the polling places in the several precincts, respectively, in the City as set Borth in the foregoing NOTICE OF SPECIAL BOND ELECTION. Not less than 20 days before said election the City Commission shall designate the Inspectors of Election and Clerk of Election for each precinct and shall publish the names of such Inspectors of Election and Clerks of Erection in a newspaper of general circulation published in the City of Miami at least 13 days before the date of election. Section *. All qualified electors of the City shall be permitted to vote in said special bond election, and the Supervisor of Elections of Cade County is hereby requested, authorized and directed to furnish, at the cost and expense of The City of Miami, a list of all qualified electors residing in The City of Miami as shown by the registration books and records of his office, and duly to certify the same for delivery to and use of the election officials designated to serve at the respective palling places in said election precincts. Section 6. The City Clerk of The City of Miami is hereby designated and appointed as the official representative of the Commission of the City in all transactions with the Supervisor cf :Elections of Dade County in relation to matters pertaining to the use of the registration books and the holding of said special bond election. Section 7. The ballot used in said election for voting on the question submitted shall be that portion of the cardboard or paper or other material within the ballot frames of the voting machines which will contain a statement of the question submitted, and said voting machines shall provide facilities for all qualified electors to vote for or against such question as they may choose. said ballot as it appears within the first row of horizontal ballot frames of the voting machines shall be substantially in 'the following form: For Against SOHD ELECTION March 7, 1978 OFFICIAL BALLOT SPECIAL BOND ELECTION MARCH 7, 1978 THE CITY OF MIAMI, FLORIDA Shall bonds of The City of Miami, Florida in an aggregate principal amount not exceeding $13,000,fl0 be issued under the provisions of Ordinance No. 8736 for the purpose of paying the cost of STORM SEWER IMPROVEMENTS, such bonds to be issued at one time or from time to time and to mature in annual install- ments 2 to 20 years, inclusive, after the date of the respective bonds, to bear interest at a rate or rates not to exceed the rate provided for in the statutes of the State of Florida and to be payable from unlimited ad valorem taxes. ;eetic8, Each elector desiring to vote for the issuance of said bonds shall be instructed to turn down the pointer or lever over the word "FOR" within the ballot frame containing the statement of the question relating to such bonds, and each elector desiring to vote against the issuance of any of said bonds shall be instructed to turn down the pointer or lever over the word "AGAINST" within the ballot frame containing the statement of the question relating to •such bands, Section 9. The City Clerk shall cause to be prepared absentee ballots containing the question, set forth in Section 7 above for the use of absent electors entitled to cast such ballots in said election. Section 10. This ordinance shall go into effect imrzediately upon its passage and shall not be subject to the right of referendum as an ordinance. Section 11. The requirement of reading this ordinance on two (2) separate days is hereby dispensed with by an affirma- tive vote of not less than four -fifths of the members of the Commission of the City of Miami.
