ORDINANCE NO. 8735
AN ORDINANCE AMENDING SECTION 39-25 OF
ARTICLE II, "MIAMI ORANGE BOWL MEMORIAL
STADIUM", CHAPTER 390 "PARRS AND RECREATION",
OF THE CODE OP THE CITY OF MIARI, FLORIDA,
AS AMENDED, BY REPEALING SAID SECTION,
WHICH HAD PROHIBITED SALE, USE, OR POSSESSION
OF ALCOHOLIC OR INTOXICATING BEVERAGES IN THE
MIAMI ORANGE BOWL MEMORIAL STADIUM, WITH
CERTAIN EXCEPTIONS, AND SUBSTITUTING A NEW
SECTION 39-25 ALLOWING AND AUTHORIZING THE
SALE OP BEER AND/OR MALT BEVERAGES IN SAID
STADIUM AND ALSO PROVIDING ?OR THE CITY
MANAGER TO AUTHORIZE SUCH SALE UPON SUCH
TERMS AND CONDITIONS AS SHALL IMPLEMENT
CITY COMMISSION POLICY, WITH THE EXCEPTION
THAT SUCH SALE NOT TAKE PLACE BEFORE,
DURING OR AFTER ANY HIGH SCHOOL EVENT OR
MUSICAL EVENT COMMONLY REFERRED TO AS A
"ROCX CONCERT"; FURTHER PROVIDING THAT SAID
SUBSTITUTED SECTION SHALL RESULT IN NO
CHANGE IN EXISTING AGREEMENTS BETWEEN THE
CITY AND STADIUM CONCESSIONNAIRES; ALSO
AUTHORIZING THE SERVING OR DISPENSING OP
INTOXICATING BEVERAGES IN AREAS OF THE
STADIUM SPECIFICALLY DESIGNATED BY THE
CITY MANAGER UNDER SUCH TERMS AND CONDI-
TIONS AS SHALL IMPLEMENT CITY COMMISSION
POLICY; CONTAINING A REPEALER PROVISION
AND A SEVERABILITY CLAUSE.

Section 1. Section 3925 of Article 1i, "Miami Orange Rawl
Memorial Stadium", Chapter 39, "Parks and Recreation", of the Code
of the City of Miami, Florida, as amended, is hereby further amended
by repealing said section in its entirety and substituting in its
place, the followings
"Section 39.25. Alcoholic and Intoxicating Beverages.
1. (a) Beer and/or malt beverages may be sold in
the stadium by the city provided that such
beverages are not dispensed to the consumer
in cans or bottles.
(b) The city manager may authorize the sale of
said beverages in the stadium by licensed
vendors.
(c) The aforesaid sale shall not be authorized
(i) before, during, or after any high
school event, including but not limited to
football, soccer, or any high school event
held at the stadium:
(ii) before, during, or after any musical
event of the type which historically requires
extraordinary security measures, based upon
prude police protection.-`l „

(d) The aforesaid sale by the city or by authorized
vendors is subject to and conditioned upon such
terms and conditions as are specified by the
city manager. Such specification shall imple-
ment policy imposed by the city commission
concerning such sale or authorization thereof.
2. Intoxicating beverages may be served or dispensed
in those areas of the stadium specifically designated
by the city manager, subject to and conditioned upon
such terms and conditions as are specified by the
city manager. Such specification shall implement
policy imposed by the city commission concerning
such serving or dispensing.
3. Except as provided herein, it shall be unlawful for
any person to bring alcoholic or intoxicating beverages
into the stadium or to possess or to drink alcoholic
or intoxicating beverages, as defined in Section
56L.01$ Florida Statutes, into the stadium.
4. there shall be no change in existing agreements
between the city and the stadium concessionaires
as A result of the passage of this ordinance."
Section a. All ordinances or parts of ordinances insofar as
they are in conflict with the provisions of this ordinance are hereby
repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance isdeclared invalid, the
remaining provisions of this ordinance shall not he affected.

Ordinance amending Sec. 39-.25
of City Code, pertaining to
alcohol at the Orange Bowl.
COPY ef rdinance.
On November 8, 1977, in a Special Straw Vote, a majority
of City of Miami electors voted to permit the sale of beer
or malt beverages within the Orange Bowl Stadium.
The Department or Public Facilities recommends the adoption
of the attached Ordinance amending Section 39-25 of the
Code of the City of Miami, Florida, as amended, by repealing
said section, and substituting a new Section 39-25 allowing
the sale of alcoholic beverages by the City in said stadium
and also providing for the City Manager to authorize such
sale, upon such terms and conditions as shall implement City
Commission policy concerning such sale or authorization;
further providing that said substituted section shall result
in no change in existing agreements between the City and
stadium concessionaires.
