HomeMy WebLinkAboutPZAB (17585) ResolutionCity of Miami PZAB Resolution Enactment Number: PZAB-R-25-026 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 17585 Final Action Date: 5/21/2025 A RESOLUTION OF THE PLANNING, ZONING AND APPEALS BOARD RECOMMENDING APPROVAL OF AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 10544, AS AMENDED, THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN OF THE CITY OF MIAMI, FLORIDA, PURSUANT TO THE EXPEDITED STATE REVIEW PROCESS SUBJECT TO SECTION 163.3184, FLORIDA STATUTES, BY AMENDING THE INTERPRETATION OF THE FUTURE LAND USE MAP AND THE CORRESPONDENCE CHART TO CREATE A NEW FUTURE LAND USE DESIGNATION CALLED "TRANSIT ORIENTED NODE"; AMENDING APPENDIX LU-1; AMENDING POLICY LU-5.1.3 AND POLICY LU-5.2.1; AND AMENDING THE FUTURE LAND USE DESIGNATION OF THE PROPERTIES GENERALLY BOUNDED BY NORTHWEST 7TH AVENUE TO THE WEST, NORTHWEST 76TH STREET TO THE NORTH, NORTHEAST 2ND AVENUE TO THE EAST AND NORTHWEST 70TH STREET TO THE SOUTH IN MIAMI, FLORIDA, APPROXIMATELY 143.75 ACRES, AS MORE PARTICULARLY DESCRIBED IN THE ATTACHED AND INCORPORATED IN EXHIBIT "A," FROM "GENERAL COMMERCIAL," "LIGHT INDUSTRIAL," "MEDIUM DENSITY MULTIFAMILY RESIDENTIAL," "MEDIUM DENSITY RESTRICTED COMMERCIAL," AND "MAJOR INSTITUTIONAL, PUBLIC FACILITIES, TRANSPORTATION AND UTILITIES" TO "TRANSIT ORIENTED NODE — 1" AND "TRANSIT ORIENTED NODE — 2"; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Comprehensive Neighborhood Plan ("MCNP") is the City of Miami's ("City") Comprehensive Plan adopted by the City pursuant to Ordinance No. 10544, as amended; and WHEREAS, the MCNP's Interpretation of the 2035-2045 Future Land Use Map ("FLUM") enumerates, defines, and sets the densities and nonresidential intensities of the future land use designations; and WHEREAS, the City created new goals, objectives, and policies in the MCNP around implementing Transit Oriented Developments ("TOD") as part of the 2022 Evaluation Appraisal and Review ("EAR"); and WHEREAS, the City defined Transit Oriented Developments under Policy LU-5.1.2 of the MCNP; and City of Miami Page 1 of 6 File ID: 17585 (Revision:) Printed On: 5/30/2025 WHEREAS, the City aspires to strengthen planning around future fixed -rail transit stations and determined a new future land use designation was justified and necessary; and WHEREAS, the proposed text changes to the MCNP create a new future land use designation called "Transit Oriented Node", which sets densities and intensities on a tiering basis to implement TOD; and WHEREAS, the proposed changes meet the intent of Goal LU-5, Objective LU-5.1, Policy LU-1.6.2, Policy HO-1.1.9, Objective TR-1, and Policy TR-1.1.4 by encouraging growth around transit stations, reducing greenhouse gas emissions, and increasing housing stock near transit stations; and WHEREAS, the area generally bounded by Northwest 7 Avenue to the west, Northwest 76 Street to the north, Northeast 2 Avenue to the east, and Northwest 70 Street to the south ("Study Area") has the Future Land Use designations of "Light Industrial," "Medium Density Multifamily Residential," "General Commercial," "Major Institutional, Public Facilities, Transportation and Utilities," and "Medium Density Restricted Commercial"; and WHEREAS, the Study Area is approximately 143.75 gross acres and 106.22 net acres — with gross including rights -of -way and net excluding rights -of way; and WHEREAS, the City proposes to amend the FLUM of the Study Area to "Transit Oriented Node — 1" and "Transit Oriented Node — 2," as described in the attached and incorporated Exhibit "A"; and WHEREAS, the proposed change would help further Policy LU-6.1.2 of the MCNP by promoting alternative modes of transportation; and WHEREAS, the proposed change is consistent with Goal LU-5 of the MCNP as it promotes equitable development of the Study Area, which was subjected to the practice of redlining, by allowing the mixture of more compatible land uses and increased density; and WHEREAS, the proposed change is consistent with Policy LU-1.6.4 of the MCNP as levels of service are adequate; and WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") has conducted a public hearing on the proposed text and map amendment; and WHEREAS, the PZAB, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City and its inhabitants to recommend to the City Commission approval of the proposed MCNP amendment, both the text amendment and th amendment to the FLUM, as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The Planning, Zoning and Appeals Board ("PZAB") recommends that the Miami City Commission amend the MCNP (Ordinance No. 10544, as amended) by amending the text in the following particulars:1 "FUTURE LAND USE GOAL LU-5 * * * OBJECTIVE LU-5.1 Policy LU-5.1.3.: Within a TOD, Bike/Pedestrian Sheds are areas with enhanced infrastructure around and accessibility to fixed -rail stations, extending the TOD up to a full mile. OBJECTIVE LU -5.2 Policy LU-5.2.1: The Neighborhood Planning program shall analyze neighborhood conditions, character, history, and needs for compliance with the Miami 21 Task Force Recommendation Report consistency with data and feedback collected from community outreach, surveys, and stakeholder interviews. The Neighborhood Planning program shall also consider amendments to the Land Development Regulations to implement adopted neighborhood master plans. INTERPRETATION OF THE FUTURE LAND USE MAP Transit Oriented Node The "Transit Oriented Node" (TOD Node) designation aspires to promote compact and walkable mixed -use neighborhoods around fixed -rail transit stations. The TOD Node is intended to apply to the areas within Transit Oriented Developments, and allows all activities included in the "Restricted Commercial," and "Major Institutional, Public Facilities, Transportation and Utilities" designations. Residential facilities (except for rescue missions) alone or in combination with other uses are allowable to a maximum density defined by a tiering schedule seen below. Also permitted is a mix of uses ranging from high density multifamily residential to high intensity office uses with retail uses on the lower floors of structures. Intensity of uses within the TOD Node land use designation are generally higher than those allowed in other areas of the city. The nonresidential portions of areas designated as "Transit Oriented Node" allow maximum floor lot ratios (FLR) by the same tiering schedule for densities as seen below. The PZAB recommends approval of an ordinance of the Miami City Commission amending the FLUM of the MCNP (Ordinance 10544, as amended) by amending the Future Land Use Designation, pursuant to Expedited State Review subject to Section 163.3184, Florida Statutes, of the properties generally bounded by Northwest 7th Avenue to the west, Northwest 76th Street to the north, Northeast 2nd Avenue to the east and Northwest 70th Street to the south in Miami, Florida, approximately 143.75 acres, from "General Commercial," 2 Words and/or figures stricken through shall be deleted. Section 5. The City Commission finds that the Comprehensive Plan amendment: a. Is necessary due to changed or changing conditions; b. Follows an Expedited State Review Process pursuant to Section 163.3184(3), Florida Statutes; c. Involves a text change to the Miami Comprehensive Neighborhood Plan; d. Is one which is not located within an area of critical state concern as designated by Section 380.0552, Florida Statutes or by the Administration Commission pursuant to Section 380.05(1), Florida Statutes ; e. Complies with the applicable density limitations set forth in the Local Government Comprehensive Planning and Land Development Regulation Act, if applicable. Section 6. If any section, part of a section, paragraph, clause, phrase, or word of this Resolution is declared invalid, the remaining provisions of this Resolution shall not be affected. Section 7. This Resolution shall become effective immediately upon its adoption.
