TRANSMISSION; MAKING FINDINGS; CONTAINING A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
APPLICANT(S): Arthur Noriega V, City Manager on behalf of the City of Miami
PURPOSE: This legislation amends the Interpretation of the Future Land Use Map to
maximum densities between 150 and 500 dwelling units per acre. This legislation also
amends the Correspondence Table to include the new designation.
FINDING(S):
PLANNING DEPARTMENT: Recommended approval.
PLANNING, ZONING AND APPEALS BOARD: On May 21, 2025 recommended
approval, by a vote of 7-1.

INSTITUTIONAL, PUBLIC FACILITIES, TRANSPORTATION AND

FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS
amended; and

enumerates, defines, and sets the densities and nonresidential intensities of the future land use
designations; and
WHEREAS, the City created new goals, objectives, and policies in the MCNP around
WHEREAS, the City defined Transit Oriented Developments under Policy LU-5.1.2 of
the MCNP; and
WHEREAS, the City aspires to strengthen planning around future fixed-rail transit
stations and determined a new future land use designation was justified and necessary; and

WHEREAS, the proposed text changes to the MCNP create a new future land use
,
basis to implement TOD; and
WHEREAS, the proposed changes meet the intent of Goal LU-5, Objective LU-5.1,
Policy LU-1.6.2, Policy HO-1.1.9, Objective TR-1, and Policy TR-1.1.4 by encouraging growth
around transit stations, reducing greenhouse gas emissions, and increasing housing stock near
transit stations; and
WHEREAS, the area generally bounded by Northwest 7 Avenue to the west, Northwest
76 Street to the north, Northeast 2 Avenue to the east, and Northwest 70 Street to the south
WHEREAS, the Study Area is approximately 143.75 gross acres and 106.22 net acres
with gross including rights-of-way and net excluding rights-of-way; and

WHEREAS, the proposed change would help further Policy LU-6.1.2 of the MCNP by
promoting alternative modes of transportation; and
WHEREAS, the proposed change is consistent with Goal LU-5 of the MCNP as it
promotes equitable development of the Study Area, which was subjected to the practice of
redlining, by allowing the mixture of more compatible land uses and increased density; and
WHEREAS, the proposed change is consistent with Policy LU-1.6.4 of the MCNP as
levels of service are adequate; and
WHEREAS, on May 21, 2025, at a duly noticed public meeting, the Planning, Zoning
Neighborhood Plan, item PZAB 2, and passed PZAB-R-25-026, recommended approval, by a
vote of seven to one (7- 1); and
WHEREAS, Ordinance No. 14384 was originally adopted by the City Commission on
July 24, 2025, and is now being re-adopted to incorporate feedback and suggestions received
from the State of Florida pursuant to the Expedited State Review Process under Section
163.3184, Florida Statutes; and
WHEREAS, the City Commission has conducted a public hearing on the proposed text
and map amendment; and
WHEREAS, the City Commission, after careful consideration of this matter, deems it
advisable and in the best interest of the general welfare of the City and its inhabitants to
approve the proposed MCNP amendment, both the text amendment and the amendment to the
FLUM, as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The MCNP, Ordinance No. 10544, as amended, is hereby amended in the

Policy LU-5.1.3.: Within a TOD, Bike/Pedestrian Sheds are areas with enhanced infrastructure
around and accessibility to fixed-rail stations, extending the TOD up to a full mile.

Policy LU-5.2.1: The Neighborhood Planning program shall analyze neighborhood conditions,
character, history, and needs for compliance with the Miami 21 Task Force Recommendation
Report consistency with data and feedback collected from community outreach, surveys, and
stakeholder interviews. The Neighborhood Planning program shall also consider amendments
to the Land Development Regulations to implement adopted neighborhood master plans.

INTERPRETATION OF THE FUTURE LAND USE MAP

Transit Oriented Node
mixed-use neighborhoods around fixed-rail transit stations. The TOD Node is intended to apply
to the areas within Transit Oriented Developments, and allows all activities included in the
designations. Residential facilities (except for rescue missions) alone or in combination with
other uses are allowable to a maximum density defined by a tiering schedule seen below.

The maximum residential density may be increased by up to one hundred percent (100%),
subject to the detailed provisions of the applicable land development regulations and the
adopted concurrency management requirements.
Also permitted is a mix of uses ranging from high density multifamily residential to high intensity
office uses with retail uses on the lower floors of structures. Intensity of uses within the TOD
Node land use designation are generally higher than those allowed in other areas of the city.

Section 3. The MCNP, Ordinance No. 10544, as amended, is further amended by

amending Appendix LU-.
Section 4. The FLUM of the MCNP is hereby amended by amending the Future Land
Use Designation, pursuant to Expedited State Review subject to Section 163.3184, Florida
Statutes, of the properties generally bounded by Northwest 7th Avenue to the west, Northwest
76th Street to the north, Northeast 2nd Avenue to the east and Northwest 70th Street to the
south in Miami, Florida
Section 5. The City Commission finds that the Comprehensive Plan amendment:
a. Is necessary due to changed or changing conditions;
b. Follows an Expedited State Review Process pursuant to Section
163.3184(3), Florida Statutes;
c. Involves a text change to the Miami Comprehensive Neighborhood Plan;
d. Is one which is not located within an area of critical state concern as
designated by Section 380.0552, Florida Statutes or by the Administration
Commission pursuant to Section 380.05(1), Florida Statutes ;
e. Complies with the applicable density limitations set forth in the Local
Government Comprehensive Planning and Land Development Regulation
Act, if applicable.

Section 6. The City Manager is directed to instruct the Director of the Planning
Department to promptly transmit after First Reading a copy of this proposed amendment to
reviewing agencies as specified in §163.3184(1)(c) for required review.
Section 7. The City Manager is directed to instruct the Director of the Planning
Department to review all comments received and to take these comments into consideration for
any necessary revisions for Second Reading of this proposed amendment.
Section 8.After Second Reading, the City must transmit the adopted amendment with
all supporting data and analysis to the State Land Planning Agency and all commenting
agencies for final review.
Section 9.If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 10. Pursuant to Section 163.3184, Florida Statutes, this Ordinance, if not timely
challenged, shall become effective thirty-
planning agency notifies the City that the plan amendment package is complete. If the
land planning agency or the Administration Commission enters a final order determining this

adopted amendment to be in compliance.
APPROVED AS TO FORM AND CORRECTNESS:

This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
