Dear *ir. Barnet:
This replies to your letter of November 29 requesting an appearance be-
fore the Civil Service Aoard on December 6, 1977 concerning the appoint-
ment of an Assistant llirector in the Department of Sanitation. Your
letter states that you believe this was a violation of. Citv_ Ordinances
and Civil Service Rules.
I am attachinc; for your information a copy of the legal opinion issued
November 22, 1976 by the Citv Attorne~•, which I believe to be dispositive
of this issue.
For this reason I am not scheduling an appearance before the Board. I am,
however, forw;~rdins; copies of this response to the City Attorney and to
members of the Board. If the City Attorney finds that my conclusion is
in error, or if members of the Board conclude that they have jurisdiction,
I will be pleased to let yob know.
