December 9, 1977 ntrtnt►4ct9. tNCIOLUAts Little Havana Activities Center Allegations, September 24, 1977 On Saturday, September 24, 1977, Ms. Marieta Fandinn, owner and editor "La Verdad" newspaper, read a letter to the City of. Miami Commis!....n containing certain allega- tions regarding the above referenced agency, and Mr. Rafael Villaverde, Executive Director of the Little Havana Activities Center. The allegations presented were: 1. The agency is employing persons who are also members of the agency's Board of Directors. It is maintained that this circumstance. is a con- flict of interest. 2. That the food served the elderly is unbalanced and inadequate; that re- ports addressing the poor quality have been filed; and, that the same food caterer continues to receive contracts for food service at a rate higher than that which could be secured through properly conducted competitive bidding. Further, that the caterer is favored because of a friendship with the agency's Executive Director, and that a portion of the contract is divided between the Executive Director and the Caterer. 3. That public funds are used for parties at the Little Havana Activities Center, hosted by the Executive Director for his friends; and. that members of various terrorist organizations meet frequently with the Executive Director at the agency. The Little Havana Activities Center has received City of Miami support, through Federal Revenue Sharing funds, since Fiscal Year 1974-75. Grassie City Manager Little Havana Activities Center Allegations, September 24, 1977 Generally, clie nt sserved are stated to be primarily low-income individuals, aged 60 years or older. Some transportation, escort, information and referral, shopping as- sistance, educational, cultural and recreational programs are also stated as program objectives. The City of Miami, the United Way and the State of Florida Department of Health and Rehabilitative Services (who administers Title VII of the Older Americans Act of 1965) share the prim^ipal funding and monitoring responsibilities for the hot meal programs. During the weeks cf October 3rd and l0th, both the United Way and the Florida Depart- ment of Health and Rehabilitative Services were contacted. The United Way agreed that two (2) paid staff members were also serving as Board Members, and had informed the agency, by letter, that this practice could lead to com- munity concern. On October 4, 1977, the United Way stated that the agency had informed them that the two (2) paid staff members had been removed from the board. Other than the two (2) staff/board members, the United Way maintained that the allegations were without foundation. • The State of Florida, Department of Health and Rehabilitative Services advised that files containing information on the bid process and caterer's contracts for 1974 and 1975 were unavailable, in that these activities occurred prior to H.R.S. reorganization and were handed by the Division of Aging in Tallahassee. Tables of comparative costs of Title VII Projects were provided, listing the following: Title VII Projects Actual Catered Meals Costs Jewish Vocational Service $1.379 Senior Centers $ .72 prepared by project Little Havana Activity Center $1.45 Community Action Agency $1.10 catered $1.25 hospital Hialeah Housing Authority $1.25 Miami Springs $1.25 Catholic Service Bureau $.10 Monroe County $1.35 '*Cost per hospital meal with increase to $1.35 after January 1, 1978. In reviewing the above costs, Little Havana Activities Center does not.receive donated commodities as does many of the foregoing, according to the Little Havana Activities Center Executive Director. Grassie g City Manager Little Havana Activities Center Allegations, September 24, 1977 Services provided by the Little Havana Activities Center were monitored, H.R.S. advised, and were considered satisfactory. Questions related to the allegation of complaints filed regularly regarding the quality and quantity of food were declared unsubstantiated by N.R.S. They advised that they have no record of any complaints being filed with their office. Price Waterhouse, Inc., provides external audit services for the agency and has provided the standard certification as to the use of appropriate tests such that the financial statements are considered a true representation of the financial condition of the corporation as the period represented by the audit. The firm does note that the standard certified public audit would not contain a re- view designed to determine whether or not Construction Catering and the Executive Director were engaged in dividing any extra financial income. City of Miami records and related interviews disclosed that four (4) persons listed as City of Miami paid staff members were members of the agency's Advisory Board: NAME Francisco rormentin (265-13-4940) Santiago Illas (265-11-4092) Luis Lopes (264-49-9182), Eulalia Pozo (262-92-7187) The same four (4) individuals were listed in 1975-76, and 1976-77. On November 18, 1977, the Executive Director, Rafael Villaverde, advised that Mr. Formentin was, in fact, a member of the Executive Board - but is no longer. The other three (3) persons listed are members of the agency's Advisory Board and, Mr. Villaverde maintains that this board is of such a nature that their participation on the Advisory Board is appro- priate. Grassie City Manager t Little Havana Activities Center Allegations, September 24, 1977 Conclusions: Of the allegations listed in Ms. Fandinq's letter, the following may be determined: 1. The allegation that "several Board Members...have been collecting. pay checks as staff," appears to be founded. • Mr. R. Villaverde confirmed that this situation and states that it has been corrected. did exist • The United Way requested that the "staff/board" member situation be corrected, and was advised that, as of October 4, this had been done to their satisfaction. 2. A. The allegation of inadequate or unbalanced food is not supported by the agency responsible for primary monitoring. • Complaint procedures internally may prevent official filing with H.R.S., in that the review process conclude with the Executive Committee of the Executive Board. • An indication exists that the agency may receive notice, in advance, of monitoring checks. 8. The allegation of favored treatment to a particular food caterer can not be founded. No formal bid procedure monitoring documents are available from H.R.S., prior to 1976, at the local District Office. The Executive Director believes that Price Waterhouse super- vises bidding procedures. - A representative of the CPA firm states that they do, in fact, supervise the entire bidding process from the advertisement to potential bidders, through the actual opening of the sealed bids and presentation to the agency's Board of Directors. The firm's representative maintains that, in his opinion, all procedures related to the bidding process are appropriate. • The Caterer (Construction Catering) states that they have followed all bid procedures, when required, and deny any extra -financial relationship with the agency's Executive Director. Further, they advised that all menus are provided in advance - to a Dietician for review of nutritional standards, and that they are checked by the State of Florida, Department of Health • and Rehabilitative Services as to quality and quantity. Further, they advised that all menus are provided in advance - to a Dieticia for review of nutritional standards, and that they are checked by the State of Florida, Department of Health and Rehabilitative Services as to quality and quantity. • The former Director of the Little Havana Activities Center nutrition projects states that the City of Miami's food program was operated in a manner similiar to that of Title VII, and outlines the following: 1973-74; No formal bidding procedure, although several companies were contacted. He is of the opinion that Construction Catering was the lowest bidder. 1974-75; First official bidding procedure. and, -again, Construction Catering was the successful bidder based not just on cost, but; due to: - Demonstrated experience . • Recommended by the Advisory Council . of participants. No apparent need to change. State Regulations, he reports, were used as the guidelines. 1975-76; No bids were solicited based upon Federal and State Regulations that permit retai':in, the same contractor if service •i11 be con- tinuing at the same level and at the same price. - The Executive Director denied any extra financial relationships with the Caterer and stated he would be willing to review his personal bank account with this reviewer. 3. A. The allegation that Federal funds were used to host parties at the Center for the Executive Director's friends can only be considered to -thc' extent that art ve been held on one occasion .but not .as o e funds used. Grassie 1 City Manager Little Havana Activities Center Allegations, September 24, 1977 - It was reported that in June, 1975, after an "elderly" party, approximately twenty (20) persons attended a later, private party. The funds used for the party were not identified as "private" or non -private. • The Executive Director maintains that Federal funds are never used for non -elderly, participant parties, and that he seldom attends parties himself. B. The allegation related to "terrorists" meeting frequently with the Executive, Director was not denied, by him. - Persons alleged to be terrorists, seen in the Executive Director's company, include: 1 6 Louis Tornes Antonio de le Cova Frank C• astro 3 - The Executive Director insists that his contact with any person, "terrorists" or other, is only related to their possible need for a social form of service, and no other purpose. When the allegations are separated into their areas of impact, i.e:: Program Effectiveness Issues and Potentially Legal Issues, the results of inquiry and review to date yield the "Board/Staff Members" allegation and the "Quality/Quantity of Food" allegation as Program Effectiveness Issues. Both issues are within the scope of being unproved through .program monitoring. And, in the case of the Board/Staff Members ..allegation, indications are that corrective action is. already occurring. Of the remaining allegations, the Potentially Legal Issue of the relation- ship between the agency and the caterer cannot be conclusively proven roo be improper. The "Parties" allegation cannot be classified Program r Legal i n that the method of financing the "parties" is unproven, as to public or personal funds. And, within the confines of definable issues, the question of "terrorists" meeting with the Executive Director would not be a Program Effectiveness concern based on current findings. Program Effectiveness Issues Meetings with officials of the Department of Health & Rehabilitative Services and the United Way have been scheduled to review, in detail, those program issues that would require cooperative efforts to correct The City of Miami Social Services contract, for FY 77-78, is being modified to provide for an approved supervised bidding process, and monitoring of vendor documents and procedures related to quantity and quality of service. 2. Potentially Legal Issues The State Attorney's Office has informally reviewed our findings, and recommends: - - a) Continued HRS, United Way and City of Miami review combined with; b) An in-depth external audit, and; c) Should the results of the foregoing so warrant, the referral of all findings to an appropriate law enforcement agency.
