BRICKELL, DECEASED, CERTAIN PROPERTY HEREIN DESCRIBED IN CONSIDERATION OF SLID FANNIE BRICKELL, INDIVIDUALLY AM) AS W !UTRIZ AND TRUSTEE UNDER THE LEST WILL AND TESTAMENT OF CHARLES C. B. BRICKELL, DECEASED, DEEDING TO THE CITT OF MIAMI CERTAIN OTHER PROPERTY DESCRIBED HEREIN NEED BY THE CITY OF MIAMI FOR APPROACH TO NORTHWEST FIFTH STREET BRIDGE, AND AUTHORIZING THE CITY IMAGER TO isusvumW THE NECESSARY DEED ON PlewOr OF THE CITY OF MIAMI FOR THE PURPOSE; AND REPELLING RESaLU- TIfI1 10. 3073. WHEREAS in the construction of the bridge across the Miami River at Northwest 5th Street it was found ueoessary to use a por- tion of Lots 2 and 3 in Block 1 Saath for street purposes as an ap- proaoh of said bridge on the wrest side of Miami River; and WHEREAS, it was further found necessary to use a part of an old fifty -foot street lying immediately west of and adjoining said Block 1 South for the said approach; and SAS, Fannie Briokell, ind3vidtullry and as executrix and trustee under the last will and testament of Charles C. B. Briokell, deceased, has agreed to deed to the City of Miami the property now 000npied and used by the City of Miami for west approach to said Northwest 5th Street bridge, in oonsideration of the City of Miami closing that certain part of South River Street (also known as South River Drivel lying on the north side of Block 38 South and hereinafter described; and in farther consideration of the City of Miami deeding to the said Fannie Briokell, individnialy and as exeou.trix and trustee under the last will and testament of Charles C. B. Briokell, deceased, the areas included within the above streets so closed by the City of Miami; and WHEREAS, the dommission of the City of Miami deems it to the best interests of the City of Miami to make the exchanges of proper- ty hereinabove set forth; now, therefore, BE IT RESOLVED BY TEE COMMISSION OF TEE CITY OF MIAMI: Section 1. That in consideration of Fannie Briokell, indivi- dually and as executrix and trustee under the last will and testa- ment of Charles C. B. Briokell, deceased, conveying to the City of Miami by special warranty deed the following described land, to -wit: That part of Lots 2 and 3 of Block A South, of the City of Miami, Dade County, Florida, a000rding to the plat of said city made by A. L. Knowlton, C.E., and reoord in Plat Book B at page 41 of the Public Records of Da M E County, Florida, to -wit: Beginning at the southeast t oorner of said Lot 3 of Block 1 South, of the City of ran Miami aforesaid, said corner being identical with the < m southwest corner of Lot 1, Baile's Re -subdivision of Lots 4, 5 and 6 of said Block A South, of the City of N N I -r, Z 11111111 ill 111111Ie11■11111I1®III®di 1111 III 111111 Miami; throe north along the east line of said lot 3 of said Block 1 South one hundred eight and one -tenths feet (108.1') more or less to the north- erly side of bridge; thence defleoting one hundred twenty-eight degrees fifty-five and one-half minutes (128 deg. 55*') left, along the northerly side of the bridge one hundred eleven and tyro -tenths feet (111.8') more or less, to a point of curve; thence westerly on - a curve with a radius of slaty feet (60') and a central angle of fifteen degrees (15 deg.) moreorloss to the west line of lot 2, Block 4 South; thence south along said west line twenty -sine and eighty-four hundredths feet (29.84') more or less to the southwest oorner of said lot 2; theme east one hundred feet (100') more or less to the point of beginning; and in further oonsideration of said Fannie Briokell, individually and as executrix and trustee under the last will and testament of Charles C. B. Briokell, deoeased; quit-olaiming to the City of Miami the following described land, to -wit: All that part of an old fifty -foot street lying im- mediately welt of and adjoining Blook A South, of the City of Miami, Dade County, Florida, a000rding to the plat of said City made by A. L. Knowlton, C. E., and recorded in Plat Book B at page 41 of the Public Re- oords of Dade County, Florida, described as follows, to -wit: Beginning at a point on the east:line of said old fifty -foot street, said point being twenty-nine and eighty-four hundredths feet (29.84') more or less north of the southwest corner of said Blook A South; thence south twenty-nine and eighty-four hundredths (29.84') feet, more or less, to the north line of Eighth Street (now called Northwest Fourth Street); then west nineteen and seven -tenths feet (19.7') more or less to the north- erly line of South River Street (now called Northwest South River Drive); thenoe northwesterly along the northerly line of South River Street (now oalled North- west South River Drive) forty andeight-tenths feet (40.8') more or less to the west line of said old fifty -foot street; thence north along said west line of said. old street three and forty-nine hundredths feet (3.49') more or leas; thence easterly along a oiroular curare whose radius is sixty feet (60') and whose oentral angle is forty-nine degrees (49 deg.) twenty-seven minutes (27') to the point of beginning; the City of Miami hereby agrees to convey to said Fannie Briokell, individually and as executrix and trustee under the last will and testament of Charles C. B. Briokell, deceased, by speoial warranty deed, the following described property, to -wit: A11 that part of South River Street, as delineated upon the plat of the City of Miami, Dade County, Florida, made by 1. L. Knowlton, C.E., and recorded in Plat Book B at page 41 of the Public Records of Dade County, Florida, lying between a line passing north and south through the southeasterly corner of lot 1, block 38 South, of the City of Miami as per said Knowlton plat, parallel with the east line of lot 13 of said block 38 south, of the City of Miami, and a line run north and south across said South River Street, parallel with the east line of lot 15 of said block 38 south, of the City of Miami, and distant west five feet (5') from said east line of said lot 15 of said. blook 38 mouth, of the City of Miami produced serous said South River Street (said South River Street referred to as per A. L. Ihavlton plat has since oome to be known as South River Drive); also all that part of said South River Street lying between the west line of lot 1 of Block A South, of the City oZ N'iami a000rding to said .1. L. IDtow1ton plat, produced north across South River Street and a lime intersecting said South River Street and dis- tant one hundred feet (100 ?) east from the west line of said lot 1, produasd north across said South River Street aforesaid, all lying and being in Dade County, Florida. Section 2. That the City 'eager be, and he is hereby author- ised to execute, for and on behalf of the City of Miami a special warranty deed conveying to said Fannie Briokell, individually and as executrix and trustee under the last will and testament of Charles C. B. Briokell, deceased, the property last above described. Section 3. That Resolution No. 3073, purporting to cover in substance the same subject matter as this resolution, be and the same is hereby repealed. PASSED AND ADOPTED this 29th day of November, A. D. 1926.
