A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AMENDING THE CITY OF MIAMI'S DEPARTMENT OF HOUSING AND
COMMUNITY DEVELOPMENT'S SINGLE FAMILY REHABILITATION
PROGRAM GUIDELINES IN ORDER TO INCLUDE A LOAN FORGIVENESS
EXCEPTION UPON THE DEATH OF THE ORIGINAL BORROWER, AS MORE
PARTICULARLY DESCRIBED IN EXHIBIT "A," ATTACHED AND
INCORPORATED; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE ANY AND ALL NECESSARY DOCUMENTS, ALL IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE.

WHEREAS, the Single Family Rehabilitation Program ("Rehab Program"), is
designated to provide funding for low-income homeowners to rehabilitate their occupied
properties so residents can achieve decent, safe, and sanitary conditions; and
WHEREAS, the Rehab Program guidelines for this housing assistance program
currently requires repayment of loan assistance upon sale, transfer or change in occupancy
of the assisted property; and
WHEREAS, there is a need to include a forgiveness exception for the Rehab Program
repayment requirements in cases where the borrower is deceased; and
WHEREAS, the City of Miami's ("City") Administration recommends amending the
City's Department of Housing and Community Development's Rehab Program Guidelines
to include a loan forgiveness exception upon the death of the original borrower, as
described in Exhibit "A," attached and incorporated;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The amendment of the City's Department of Housing and Community
Development's Housing Program Guidelines, as described in Exhibit "A," attached and
incorporated, in order to include a loan forgiveness exception upon the death of the original
borrower, is authorized.'
Section 3. The City Manager is authorized to negotiate and execute any and all
necessary documents, in a form acceptable to the City Attorney, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption.
