A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
CONFIRMING THAT ALL NECESSARY DOCUMENTS, PURSUANT TO CHAPTER
163, PART III, FLORIDA STATUTES HAVE BEEN TRANSMITTED TO MIAMI DADE
COUNTY ("COUNTY") FOR THE PURPOSE OF CREATING THE ALLAPATTAH
REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY
("ALLAPATTAH CRA"), THEREBY URGING THE COUNTY TO PROCEED WITH THE
ESTABLISHMENT OF THE ALLAPATTAH CRA; FURTHER PURSUANT TO SECTION
163.410, FLORIDA STATUTES, REQUESTING A DELEGATION OF POWERS FROM
THE COUNTY TO THE CITY OF MIAMI ("CITY") TO PROCEED WITH THE
CREATION AND OPERATION OF THE ALLAPATTAH CRA; PROVIDING THAT THIS
RESOLUTION IS WITHOUT PREJUDICE TO ANY FUTURE ACTION THAT MAY BE
FILED PURSUANT TO THE TIME LIMITATIONS SET FORTH IN SECTION 163.410,
FLORIDA STATUTES; PROVIDING FOR TRANSMITTAL, CORRECTIONS, AND AN

COUNTY ("COUNTY") FOR THE PURPOSE OF CREATING THE ALLAPATTAH
REDEVELOPMENT DISTRICT COMMUNITY REDEVELOPMENT AGENCY
("ALLAPATTAH CRA"), THEREBY URGING THE COUNTY TO PROCEED WITH THE
ESTABLISHMENT OF THE ALLAPATTAH CRA; FURTHER PURSUANT TO SECTION
163.410, FLORIDA STATUTES, REQUESTING A DELEGATION OF POWERS FROM
THE COUNTY TO THE CITY OF MIAMI ("CITY") TO PROCEED WITH THE
CREATION AND OPERATION OF THE ALLAPATTAH CRA; PROVIDING THAT THIS
RESOLUTION IS WITHOUT PREJUDICE TO ANY FUTURE ACTION THAT MAY BE
FILED PURSUANT TO THE TIME LIMITATIONS SET FORTH IN SECTION 163.410,
FLORIDA STATUTES; PROVIDING FOR TRANSMITTAL, CORRECTIONS, AND AN
EFFECTIVE DATE.
WHEREAS, the Florida Legislature enacted the Community Redevelopment Act of 1969
which is presently codified in Chapter 163, part III, Florida Statutes, as amended (the "Act"); and
WHEREAS, on April 10, 2025, the City of Miami ("City") Commission, pursuant to the
Act, adopted Resolution No. R-25-0124,attached and incorporated as Exhibit "A," which
approved the Finding of Necessity ("FON"), declaring the certain areas of Allapattah, as outlined
in the FON to be slum and blighted and in need of redevelopment ("Area") and declaring the
need to establish the Allapattah Redevelopment District Community Redevelopment Agency
("Allapattah CRA"); and
WHEREAS, on April 24, 2025, the City Commission adopted Resolution No, R-25-0153,
which pursuant to Section 163.360 of the Act, approved the Redevelopment Plan ("Plan") for the
Area and acknowledged that the Plan is in conformity with the City's Comprehensive
Neighborhood Plan and further expressing the need to create the Allapattah CRA; and
WHEREAS, upon adoption, both the FON and the Plan were transmitted to Miami -Dade
County (the "County"), pursuant to the requirements of the Act; and
WHEREAS, the establishment and operation of the Allapattah CRA would serve to
eliminate slum and blight, stimulate economic development, and improve the quality of life for
residents; and
WHEREAS, Section 163.410 of the Act provides "In any county which has adopted a
home rule charter, the powers conferred by this part shall be exercised exclusively by the
governing body of such county"; and
WHEREAS, pursuant to Section 163.410 of the Act, a municipality may not exercise
community redevelopment powers within a county unless the county delegates such powers to
the municipality; and
WHEREAS, the City, in accordance with Section 163.410 of the Act, seeks the
delegation of powers from the County to proceed with creating and operating the Allapattah
CRA in accordance with the Act; and
WHEREAS, the City Commission urges the County Commission to take up this matter
and grant the necessary delegation of powers to the City to allow for the timely and effective
implementation of redevelopment efforts in the Allapattah Area; and
WHEREAS, this Resolution is adopted without prejudice to any future legal action that
may be filed by the City pursuant to the time limitations specified in Section 163.410, Florida
Statutes; and
WHEREAS, the City Commission finds that this Resolution is in the best interest of the
residents of the City and the Allapattah community;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the preamble to this Resolution are
adopted by reference and incorporated as if fully set forth herein.
Section 2. The City Commission hereby confirms that all documents pursuant to the Act
have been transmitted to Miami -Dade County for the purpose of creating the Allapattah
Redevelopment District Community Redevelopment Agency.
Section 3. The City Commission hereby urges the County to proceed with the
establishment of the Allapattah Redevelopment District Community Redevelopment Agency.
Section 4. The City Commission furthers, pursuant to Section 163.410, Florida Statutes,
requests the delegation of powers from Miami -Dade County to the City to proceed with the
creation and operation the Allapattah Redevelopment District Community Redevelopment
Agency, in accordance with the Act.
Section 5. This Resolution is adopted without prejudice to any future legal action that
may be filed by the City pursuant to the time limitations specified in Section 163.410, Florida
Statutes.
Section 6. The City Clerk is directed to transmit a copy of this Resolution to the Miami -
Dade County Commission, the Mayor of Miami -Dade County, and the Miami -Dade County
Office of Management and Budget.
Section 7. This Resolution shall become effective immediately upon its adoption.
